The meeting was called to order at 10:05 a.m. by Committee Chair Alvin Starkenburg in
the Council Committee Room, 311 Grand Avenue.

COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL
CONSIDERATION OF HEARING EXAMINER =S RECOMMENDED
APPROVAL OF A MAJOR DEVELOPMENT PERMIT FILED BY PACIFIC
INTERNATIONAL TERMINALS FOR AGATEWAY PACIFIC TERMINAL

Starkenburg stated committee needs to, first of all, approve the project and second,
approve the Hearing Examiner's conditions.

asked to comment [below]; Tull then commented [below]).
Bill Florea, Planning and Development Services, Land Use, stated the Hearing
Examiner's report is complete and deferred their report to that.
Bob Tull of Langabeer, Tull, & Cuillier, gave a brief presentation on the scope of the
project. This location is the only remaining undeveloped deep -water port on the West Coast and
one of the few in the world able to accommodate very large vessels without dredging. This
project will provide a significant facility for world -wide cargoes to come into the area. A part of
this scheme is access to other properties. Once Council approval is received, there must be state
and federal approvals before construction can begin. Lummi and Nooksack tribes are also
cooperating on this project. There are numerous conditions set forth by the Hearing Examiner.
The applicants approve of the Hearing Examiner's decision and can comply with the conditions.

Florea stated that County Planning staff is in full support of the conditions as outlined in
the Hearing Examiner's report.
Starkenburg stated that everyone was in agreement with the conditions; no one had any
questions regarding the project.
Sutter moved to recommend approval of the project and all conditions to full Council.
Dawson asked Tull about condition #43 regarding a park -like development. Tull replied
in the negative. Further, the proposed condition also involved County Parks. It is anticipated
there will likely be additional areas that will become available, but there are no plans for that
type of development in the area specified in this condition. This project does not interfere with
beach access and, therefore, does not require areas developed for recreation.
Motion carried unanimously.
