HomeMy WebLinkAboutPublic Works February 24 1998WHATCOM COUNTY COUNCIL Public Works and Capital Projects Committee February 24, 1998 The meeting was called to order at 1:30 p.m. by Committee Chair Barbara Brenner in the Council Committee Room, 311 Grand Avenue. Also Present: Marlene Dawson Tom Brown Absent: None COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL 1. DISCUSSION REGARDING VAN WYCK ROAD COMPLAINT FILED BY GREG AND CINDY ANDERSON AND GEORGE LEONARD (AB97 -413) (This item has been removed and will be discussed at the March 10 committee meeting) Brenner read a letter from Jeff Monsen, Public Works Director, regarding this item. Cindy Anderson, 347 Van Wyck Road, commented about the withdrawal of this item. She requested clarification regarding the mylar correction and stated that the short platting would be challenged, as she has no recourse. Dave Wareing, Executive's Office, replied in response to Anderson's statements. Discussion followed on the County road; reaching a solution; legal issues involved before a solution can be reached. Dan Gibson, Prosecuting Attorney's Office, commented regarding the short plat. George Leonard, 247 Van Wyck Road, commented about redoing the trail permit. Wareing responded. Leonard requested notification. Ed Henken, Public Works, commented regarding the mylar process, as did Mike Donahue. He stated the mylar was returned redlined to the surveyor. If the road is not up to County standards, Donahue stated it must be approved by Council. Gibson pointed out in order for the mylar to be signed, an agreement must be made as to who will maintain the road. Brenner requested the legal parameters of this issue. Wareing stated he would discuss this with Monsen and check on the status of the mylar. Anderson requested that the committee notify the property owners on the road regarding any meetings, etc. She asked Donahue about the redlined area, specifically to the maintenance section on the mylar. Public Works Minutes, 2/24/98, Page 1 Gibson stated there are three basic ways to address a past problem: RID; latecomers; and obligations not met can be met through a misdemeanor, which involves a significant amount of money. Gibson pointed out Council must Insist on minimum standards. OTHER BUSINESS 1. DISCUSSION REGARDING BLUE CANYON ROAD COMPLAINT FILED BY RITA FOLEY (AB98 -100) file). Rita Foley addressed committee on the widening of Blue Canyon Road. Ed Henken, Public Works, explained the process this item has gone through (handout on (Clerk's Note: Tape 1, side B) Topics discussed included an engineering study advisory decision. Dan Gibson, Prosecuting Attorney's Office, addressed the ordinance and Council action. Brenner requested Gibson find the absolute minimum width for a County road. Gibson responded. Henken responded to a question regarding the buildout on the road. County liability is on the line. Also in question was the stability of the banks. Mark Lawrence clarified the location of the proposed project. He reviewed the process he and his wife went through to enjoy his property and the resulting phone calls to the Sheriff's Office regarding tresspassors. He spoke to the turnout criteria. Brenner inquired about giving this County road away. Hinton pointed out that if Lawrence could sell his property, there would not be a problem. Gibson addressed the issue of vacation. The future capacity is 25 permanent residents for that road. Brenner stated the committee will contact the Sheriff's department to see if they have any suggestions.
