Also Present: Absent: Marlene Dawson None Tom Brown COMMITTEE DISCUSSION 1. SPECIAL PRESENTATION BY RALPH JEFFERSON REGARDING LUMMI LAW AND ORDER (AB98 -179) Ralph Jefferson, Chief of Police for Lummi Law and Order, gave background information regarding the Lummi Tribal Police office. There are 16 commissioned police officers including detectives and natural resources enforcement. He described the special education of his officers, the role of Lummi Law and Order in making arrests of Indians and non - Indians. He gave background on the process for jurisdiction of juvenile offenders. He explained someone who commits a crime on the reservation could be convicted both in Tribal court, which is basically a misdemeanor court, and also State or Federal court. Discussion followed. Topics discussed included crimes and consequences; referrals to tribal court; victims facing accusers; state and federal involvement and/or the lack thereof, referrals to the Sheriff Department; on and off Lummi boundaries regarding County vs. Lummi jurisdiction; jail facilities lacking on the reservation; various complaints regarding the public's misconception of events; taxes; Lummi restraining orders not enforced by the County; reciprocity between tribal and state courts; Participating in the discussion was Dave Wareing, Executive's Office. 2. DISCUSSION REGARDING COMPLAINT FILED BY CITIZEN DICKINSON (AB98 -180) Dave Dickinson gave background information regarding his complaint, which revolves around a plat problem and involves boundaries. Dan Gibson, Prosecuting Attorney's Office, stated a long -plat application is pending, which may lead to Council review. Short plats are subject to appeal. He pointed out this may be a personnel matter, which Administration deals with - -not the Council. Wareing stated this issue warrants investigation and the issue should have been returned to court. He would follow through. COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL 1. NOTIFICATION OF A PROPOSED REQUEST FOR PROPOSAL FOR WASTE REDUCTION & RECYCLING /HOUSEHOLD HAZARDOUS WASTE TO DESIGN AND IMPLEMENT AN EDUCATION AND PROMOTION PROGRAM FOCUSING ON WASTE REDUCTION AND RECYCLING, AND HOUSEHOLD HAZARDOUS WASTE, IN THE EXPECTED AMOUNT OF APPROXIMATELY $110,000 (AB98 -167) Ravyn Whitewolf , Solid Waste, distributed a handout and spoke to this issue. She requested Council direction regarding activities. Whitewolf mentioned speaking before assemblies and classroom. Discussion followed. Topics discussed included funding enforcement of laws; trash; classroom education programs; making recycling easier; Brenner moved to recommend Solid Waste's REP going forward. Motion carried 2 -1 with Brown opposed. Also participating in the discussion was Kathy Sutter, Council member. 2. NOTIFICATION OF A PROPOSED REQUEST FOR PROPOSAL FOR LOCAL WASTE REDUCTION & RECYCLING EDUCATION & PROMOTION GRANT PROGRAM TO DEVELOP NEW AND INNOVATIVE PROJECTS /PROGRAMS TO SUPPORT THE COMMUNITY'S WASTE REDUCTION AND RECYCLING EFFORTS (AB98 -168) Ravyn Whitewolf, Solid Waste, discussed this program. Brenner moved to recommend the RFP for the grant. Motion carried 2 -1 with Brown opposed. 3. RESOLUTION SCHEDULING A PUBLIC HEARING TO CONSIDER AUTHORIZING A SYSTEM OF ASSESSMENT FOR DIKING DISTRICT NO. 3 (AB98 -169) be set. Tom Hayden, Public Works Engineering, reported the Treasurer requested a $5 minimum Public Works Committee, 4/21/98, Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 Lara McKinnon, Public Works Engineering, commented regarding the ordinance. Karen Frakes, Prosecuting Attorney's Office, addressed the legal issue on holding a hearing when an ordinance has changed. Brenner moved to recommend scheduling a public hearing for this item as well as item #4. Motion carried unanimously. 4. RESOLUTION SCHEDULING A PUBLIC HEARING TO CONSIDER AUTHORIZING A SYSTEM OF ASSESSMENT FOR DIKING DISTRICT NO. 4 (AB98 -170) See above.
