Also Present: Absent: Ward Nelson None Connie Hoag COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL 1. ORDINANCE AMENDING WHATCOM COUNTY CODE 6.04, ANIMAL CONTROL (AB98 -103) Nelson explained the ordinance and the addition of exotic animals. Dean and Deborah Akers explained caged hunts and the use of these animals. They explained expense of the vets, and they want to save these tigers. This is a non - profit venture, they explained the need to save these tigers from the caged hunts. Susan Donato, Security Specialists Plus (SSP) Animal Control Administrator, explained the need to ensure public safety, and that the keeping of exotic pets is not safe for the public and should remain prohibited. Dawson expressed concerns regarding land use and the notification of the neighbors. Nelson explained that there are already exotic animal sanctuaries that do not require land use permits. Chuck Benjamin, Health and Human Services Director, suggested adding that the inspections from the United States Department of Agriculture (USDA) should be given to SSP for review. Discussion followed regarding distinguishing between sanctuary and pets. Karen Frakes, Senior Civil Deputy Prosecutor, explained the need for a conditional use permit, and stated that this would require the individuals to get two permits. MaryLee Rustand, SSP, explained the need for a permit for the transport purposes. 2. CONTRACT WITH OWENS, DAVIES, MACKIE FOR LEGAL SERVICES FOR THE COUNTY S APPEALS OF THE DECISIONS OF THE WESTERN Finance and Administrative Services Committee, 3/24/98, Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 WASHINGTON GROWTH MANAGEMENT HEARINGS BOARD IN CASE NUMBERS 94 -2 -0009, 96 -2 -0008, AND 97- 2 -0030C (AB98 -120) Karen Frakes explained the contract. (Clerk's Note: End of tape one, side A) Hoag stated that it skips section 8. Frakes explained it is just a typographical error and can be corrected. Nelson moved to recommend approval. Motion carried 2 -1 with Hoag opposed. COUNCIL "CONSENT AGENDA" ITEMS 1. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A CONTRACT WITH ERICCSON, INC., FOR THE PURPOSE OF PROVIDING AN UPGRADE TO THE TELEPHONE SYSTEM, IN THE AMOUNT OF $50,623 (AB98 - 121) Sutter questioned whether the contract includes training. On page 29, it does not include training. However, #4 refers to exhibit A, page 34, which states the price includes training. George Reid, Administrative Services Information Services Manager, explained this is regarding training of County staff. Nelson moved to recommend approval. Motion carried unanimously. 2. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO AWARD THE BIDS FOR TWO CLASS G ASPHALT PRELEVEL PROJECTS (BID #98 -21 IN THE NORTHCENTRAL AREA IN THE AMOUNT OF $378,308; AND BID #98 -22 IN THE NORTHEAST AREA IN THE AMOUNT OF $235,045), TO THE LOWEST RESPONSIVE BIDDER, WILDER CONSTRUCTION COMPANY, INC., IN THE TOTAL AMOUNT OF $613,353 (AB98 -122) Hoag moved to recommend approval. Motion carried unanimously. 3. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A CONTRACTBETWEEN THE WHATCOM COUNTY HEALTH AND HUMAN Finance and Administrative Services Committee, 3/24/98, Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 SERVICES DEPARTMENT AND LAKE WHATCOM RESIDENTIAL AND TREATMENT SERVICES, TO PROVIDE SUPPORTED LIVING SERVICES FOR MENTAL HEALTH CLIENTS, IN THE AMOUNT OF $63,840 (AB98 -123) Nelson questioned whether the clients receive adequate facilities. He also questioned the water quality. Chuck Benjamin, Health and Human Services Director, stated that he will check into the water issues. Sutter questioned how the admission figures are being monitored. Nelson moved to recommend approval. Motion carried unanimously. 4. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A CONTRACT BETWEEN WHATCOM COUNTY AND WHATCOM COUNSELING & PSYCHIATRIC CLINIC, TO PROVIDE A VARIETY OF MENTAL HEALTH SERVICES, IN THE AMOUNT OF $133,553 (AB98 -124) Chuck Benjamin, Health and Human Services, explained that the facility does assessments for the Jail and the County. Hoag moved to recommend approval. Motion carried unanimously. 5. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO AN AMENDED INTERLOCAL AGREEMENT BETWEEN WHATCOM COUNTY AND THE CITY OF BELLINGHAM, TO OPERATE THE LAKEWAY DRIVE YARD WASTE COLLECTION FACILITY AND FOR TRANSPORT OF MATERIAL TO A PERMITTED COMPOST FACILITY, IN THE AMOUNT OF $50,000 (AB98 -125) Ravyn Whitewolf, Public Works Solid Waste Division, explained it is a budgeted out of $50,000 and has been approved by the Solid Waste Committee. The Advisory Committee asked that staff analyze the export of the materials. Nelson moved to recommend approval. Motion carried unanimously. 6. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A JOINT FUNDING AGREEMENT WITH USGS FOR A WHATCOM COUNTY EARLY Finance and Administrative Services Committee, 3/24/98, Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 FLOOD WARNING SYSTEM, WITH A TOTAL PROJECT COST OF $70,070; WHATCOM COUNTY'S ESTIMATED SHARE IN THE AMOUNT OF $23,925 (AB98 -126) Lara McKinnon, Public Works Engineering Division, explained that this is the part of the annual maintenance contract. Hoag moved to recommend approval. Motion carried unanimously. 7. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A COOPERATIVE AGREEMENT WITH THE NATURAL RESOURCES CONSERVATION SERVICE (MRCS) FOR THE CONTINUATION OF THE WHATCOM COUNTY EARLY FLOOD WARNING SYSTEM FOR FIVE YEARS, IN THE AMOUNT OF $5,000 PER YEAR, NOT TO EXCEED A FIVE -YEAR TOTAL AMOUNT OF $25,000 (AB98 -127) Lara McKinnon, Public Works Engineering Division, commented. Hoag moved to recommend approval. Motion carried unanimously. 8. RESOLUTION SETTING A HEARING AND NOTICE OF HEARING ON DECLARING COUNTY -OWNED PROPERTY TO BE SURPLUS AND AVAILABLE FOR DISPOSAL AT A PUBLIC AUCTION, REQUEST #95 -61 (AB98 -128) Dawson asked if it was a conflict of interest for a council member to bid on the surplus items. Brad Bennett, Administrative Services Finance Division Manager, explained that the Council is a part of the process of selling the property. Hoag questioned the sale of the 1994 pick up truck. Mary Scrimsher, Public Works Equipment Revolve and Rental (ER &R) Division Manager, explained that the 1994 pick up is in bad shape and has 125,000 miles. It is in poor condition. She also explained the equipment rental process, and the ER &R account. Dick Prieve, Public Works Maintenance and Operations (M &O) Manager, explained that the cost of vehicles and maintenance keep going up. Nelson moved to recommend approval.
