September 12, 2000
The meeting was called to order at 5:45 p.m. by Council Chair Marlene
Dawson in the Council Committee Room, 311 Grand Avenue, Bellingham,
Washington.

1. DISCUSSION REGARDING THE POSSIBLE APPOINTMENT OF A JUDGE
TO FILL THE UNEXPIRED TERM OF RETIRING JUDGE DAVID RHEA
(AB2000 -017)
Dawson stated that there is going to be an election very shortly. It puts a
judge in an easier position to be elected if the Council appoints him or her. It might
be fairer to leave it and let the temporaries filling in.
Imhof stated there is a pro tempore. That is the appropriate manner to fill
the position. It would save everyone the grief of appointing someone.
Hoag stated the County Auditor gave them their options.
Brenner stated one option was to not do anything.
Imhof stated the person takes over when the election is certified.
Dewey Desler, Deputy Administrator, stated the administration
recommended letting the pro tempores fill the position. The Council has a choice to
appoint a judge. Judge Rhea leaves office at the end of September. A new judge
would not be sworn in until November 22. There would be seven and a half weeks.
There are enough pro tempores to do this. By using just pro tempores, the County
would save approximately $4,000.
Imhof stated the Council needs to make a motion on the Council floor.
Hoag questioned whether it would automatically be on the regular ballot.
Desler stated it would be on the general election.

Hoag questioned whether letting it ride would generate any additional cost.
Desler stated it would not. It actually saves money of the court.
Hoag questioned whether there would still be an election if they appoint
someone. Desler stated there would still be an election.

Imhof moved to go into executive session for approximately 40 minutes to
discuss the last four items on the agenda.
