Also Present: Absent: Marlene Dawson Sam Crawford COUNCIL "CONSENT AGENDA" ITEM 1. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO AWARD BID #01- 33 TO THE LOWEST RESPONSIVE BIDDER, WILDER CONSTRUCTION COMPANY, FOR THE FERNDALE /LUMMI AREA PRELEVEL PROJECT, IN THE AMOUNT OF $439,695 (AB2001 -136) Dawson moved to recommend approval. She questioned where the project is located. Imhof stated they do the prelevel one year, and then chip seal over the top of the prelevel the next year. Mike Roberts, Assistant County Road Engineer, stated the location is west of Ferndale and in the Lummi Nation area. He had a list of roads. Motion carried unanimously. 2. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO AN AGREEMENT BETWEEN WHATCOM COUNTY PUBLIC WORKS SOLID WASTE AND GENERAL CONSTRUCTION COMPANY FOR THE CEDARVILLE LANDFILL CUT -OFF WALL, IN THE AMOUNT OF $103,380 (AB2001 -137) Dawson moved to recommend approval. She questioned the life expectancy of the wall. Dick Prieve, Assistant Director of Administration, stated it is a steel sheet pile wall with a life expectancy of 30 to 50 years. Motion carried unanimously. 3. She questioned where the property is located. Imhof suggested asking the Assessor. Motion carried unanimously. 4. RESOLUTION SETTING HEARING AND NOTICE OF HEARING ON SURPLUS OF COUNTY PROPERTY, REQUEST #02 -01 (AB2001 -139) Dawson moved to recommend approval. Motion carried unanimously. 5. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A CONTRACT AGREEMENT BETWEEN WHATCOM COUNTY HEALTH AND HUMAN SERVICES DEPARTMENT AND WHATCOM COMMUNITY HEALTH PARTNERSHIP TO SUPPORT COMMUNITY IMPROVEMENT INITIATIVES FOLLOWING THE PUBLIC HEALTH IMPROVEMENT PLAN DIRECTIVE, IN THE AMOUNT OF $40,000 (AB2001 -140) Dawson moved to recommend approval. Motion carried unanimously. 6. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO ENTER INTO A CONTRACT BETWEEN WHATCOM COUNTY AND THE SUDDEN VALLEY COMMUNITY ASSOCIATION TO ACQUIRE PROPERTIES WITHIN THE LAKE WHATCOM WATERSHED IN THE AMOUNT OF $23,584.03 (AB2001 -141) Imhof moved to recommend approval. Dawson stated they are not actually acquiring property, but only acquiring the restrictive covenants. Dewey Desler, Deputy Administrator, stated they finalized an agreement that protects the County's interest by passing this money on to Sudden Valley to protect those lots. If this works, there may be other requests like this from Sudden Valley as they attempt to maintain an appropriate level of acquiring property out there. Dawson stated the County approved the Sudden Valley plat, and it is up to the County to clean it up. Desler stated he talked to the city councilmembers, who said they don't have policies for addressing properties even in the city limits. In the future, look at using Conservation Futures funds for those kinds of acquisitions. Motion carried unanimously. Suzanne Blangsted, Sudden Valley, stated she would bring the comments about public access to the Sudden Valley Board. OTHER BUSINESS Dewey Desler, Deputy Administrator, stated there has been a recommendation from the Rural Sales Tax Advisory Committee and all the mayors to use the rural development sales tax rebate on a project on the Washington Community Economic Revitalization Team (WA -CERT) priority list with the Public Utility District (PUD). The Port is active in that effort. The administration will discuss it with the committee soon. They have not budgeted any money for this, even though they are collecting resources in the fund. They need policies and procedures in place, and will address the outcomes and results. Also, they will talk about making detailed plans on the use of the Civic Center building. They do not anticipate using appropriation authority or any contract approval. The scope of activities will be limited. The things underway are funded with already- appropriated money. The use will be primarily for the Public Works Department and a small portion of the Public Defender's Office.
