WHATCOM COUNTY COUNCIL
Special Committee Of The Whole
February 3, 2004
Council Chair Dan McShane called the meeting to order at 4:15 p.m. in the
Council Committee Room, 311 Grand Avenue, Bellingham, Washington.
Present:
Barbara Brenner
Laurie Caskey- Schreiber
Seth Fleetwood
Sharon Roy
L. Ward Nelson
Absent:
Sam Crawford
McShane stated he would recuse himself from discussion of the BP Co-
generation plant issue when it comes up from the agenda. He moved to go into
executive session for approximately 15 minutes to discuss the three agenda items.
Motion carried 5 -0 with Nelson out of the room and Crawford absent.
2. DISCUSSION WITH SENIOR CIVIL DEPUTY PROSECUTOR DAVE
GRANT REGARDING LEGAL ISSUES OF JOINING A MOTION FROM A
GROUP REGARDING THE GEORGIA STRAIT CROSSING.
3. DISCUSSION WITH SENIOR CIVIL DEPUTY PROSECUTOR DAVE
GRANT OF A LAWSUIT REGARDING THE CONTINUATION OF
WHATCOM COUNTY SUPERIOR COURT CAUSE NO. 04 -2- 00263 -6
(AB2004 -018).
(Clerk's Note: The Committee of the Whole came out of executive session to
take action on this item.)
McShane moved to have Senior Civil Deputy Prosecuting Attorney Dave
Grant file a lawsuit regarding case number 04 -2- 00263 -6.
Motion carried unanimously.
1. DISCUSSION WITH SENIOR CIVIL DEPUTY PROSECUTOR DAVE
GRANT REGARDING BP COGENERATION PLANT SETTLEMENT
NEGOTIATIONS.
McShane moved to go into executive session to discuss this item.
Motion carried unanimously.
