August 10, 2004
Council Chair Dan McShane called the meeting to order at 6:30 p.m. in the
Council Committee Room, 311 Grand Avenue, Bellingham, Washington.

Sam Crawford
2. DISCUSSION REGARDING PENDING LITIGATION (THOUSAND
FRIENDS OF WASHINGTON AND PRO WHATCOM) (AB2004 -018)

McShane moved to go into executive session for approximately 30 minutes.
Motion carried unanimously.
1. DISCUSSION WITH SENIOR DEPUTY PROSECUTOR DANIEL GIBSON
REGARDING A PENDING CONDEMNATION ISSUE (AB2004 -018)
Dan Gibson, Senior Civil Deputy Prosecutor, stated the Public Works
Department is expanding Austin Creek bridge at Sudden Valley. Typically, the
County purchases right -of -way. Because of the covenants at Sudden Valley, the
County can't buy the right -of -way without going through a condemnation process.
It's 5,558 square feet, which is a thin sliver that allows the County right -of -way
where the expansion is occurs. He asked if the Council approves.
Caskey- Schreiber moved to approve the condemnation as described by Mr.
Gibson.
Motion carried unanimously.
