WHATCOM COUNTY COUNCIL Regular County Council November 22, 2005 Council Chair Laurie Caskey- Schreiber called the meeting to order at 7:00 p.m. in the Council Chambers, 311 Grand Avenue, Bellingham, Washington. Ward Nelson FLAG SALUTE ANNOUNCEMENTS Absent: None Caskey- Schreiber announced there was discussion and negotiations update on collective bargaining agreements (AB2005 -062) in executive session during Committee of the Whole meeting. Caskey- Schreiber announced there was discussion of a resolution amending resolution No. 2004 -067, the 2005 unrepresented resolution (AB2004 -387A) in executive session during the Committee of the Whole meeting. Fleetwood moved to approve the resolution. Motion carried unanimously. Caskey- Schreiber announced there was discussion of a resolution approving a salary schedule and policies for unrepresented Whatcom County employees for the year 2006 (AB2005 -441) in executive session during the Committee of the Whole meeting. Brenner moved to approve the resolution. Motion carried unanimously. PRESENTATION BY PUBLIC WORKS ASSISTANT DIRECTOR JOE RUTAN OF THE 2005 OUTSTANDING BICYCLE AND PEDESTRIAN PROJECT AWARD (AB2005 -017) Joe Rutan, Assistant Director, introduced Todd Carlson from the Washington State Department of Transportation, who will present the award to the County. Todd Carlson, Washington State Department of Transportation Operations and Planning Manager, stated he has awarded the Outstanding Bicycling and Pedestrian Award to Whatcom County. With the new partnership account, it looks like they will have funds to do a lot more construction in Whatcom County. There are now provisions for people to walk and bike in areas where they couldn't before. He thanked Executive Kremen, Mr. Andy Kamkoff from the Lummi Nation, and Gary Goodall from the Public Works Department. He presented the award to Executive Kremen. Pete Kremen, County Executive, stated he accepts the award on behalf of the County with great honor and pride. This community places a high value on hiking and bicycling as alternatives to traditional modes of transportation. Over the past several years, the County has tried to enhance those opportunities. He recognized the partnership with the State and the Lummi Nation. The effort has been collaborative. This community is better for it. Brenner stated she would like to also recognize the Bicycle and Pedestrian Committee for all their hard work. Kremen stated the committee's work has been the driver for most or all of these accomplishments. Andy Kamkoff, Lummi Nation, stated the Lummi Nation appreciates the opportunity to work on these projects, which have really helped the people who use Kwina Road. REGULAR COUNTY COUNCIL FOR NOVEMBER 9, 2005 OPEN SESSION The following people spoke: Rosalinda Guillen, 1800 - 20th Street, Bellingham, stated the Council approved a resolution supporting professionally trained public policing agencies and opposing armed militia enforcing against border and other crimes (AB2005 -431). The Coalition for Professional Law and Border Enforcement and people who have done a lot of work on the Minutemen project and border vigilantes are very unhappy with this resolution. Pass the resolution that people requested the Council to pass. The Minutemen are not mentioned in the resolution that the Council passed. The Minutemen project said it would be done at the end of October, but they met over Veteran's Day and said they would be back in the Spring. The Minutemen believe they have the approval of the County Council, Border Patrol, and County Sheriff to continue their operations. She asked if this is true. Their continued operations show it is true. The movement is going to grow. They are not going to go away. They continue to organize and recruit. Representatives have said their job is to intimidate law enforcement. This month, they are videotaping employers across the country to intimidate the employers and people of color, by insinuating the people of color are illegal and by calling the Immigration and Naturalization Service (INS). This kind of immigrant intimidation is continuing. It is racist activity. She continues to insist this is a racist group. Many national organizations call the Minutemen project a vigilante hate group. She submitted information on community education about the Minutemen project, border vigilantes, and racist activities (on file). Jeff Margolis, 5465 Potter Road, Deming, stated he has spoken with some County councilmembers privately about the issue of the Minutemen. Everyone is entitled to express themselves. He had hoped Councilmember Brenner would speak to Bellingham City Council Member Barbara Ryan about what happened after Ms. Ryan sponsored the City's resolution on this measure. Subsequent to the City's resolution, it was reported that Ms. Ryan wound up on hate lists. The very good intentions of the people of this community might have been taken advantage of. Their good intentions should not be considered an endorsement of some nefarious activity. Follow this up to find out the truth of the matter, and consider that when deciding on this issue of the resolution supporting professionally trained public policing agencies and opposing armed militia enforcing against border and other crimes (AB2005 -431). Larry Hildes, 4026 Fir Street, stated he is speaking on behalf of the Bellingham Chapter of the National Lawyers Guild. He is glad the Council passed the resolution at the last meeting about vigilante groups. The resolution doesn't mention the Minutemen. Also, some of the wording implies that the Minutemen have a legitimate concern on which they are acting. That is a very dangerous premise. The Minutemen are engaging in acts of intimidation and violence against a group of people whose jobs are not there, who are not terrorists or a threat to national security, and who are trying to build lives for themselves. The language implies that the Minutemen are trying to protect the United States against terrorism. However, the Minutemen are acting in a manner that is racist. It existed before 9/11 and would exist if 9/11 had not happened. These people were doing these things 20 years ago. The group needs to be named and people need to speak against the Minutemen. This is not an opportunity to wave the flag and say they are against terrorism. Everyone is against terrorism. That doesn't have anything to do with what is really going on. He asked the Council to pass a resolution that condemns a particular group that is committing particular acts on the southern and northern borders. Address the issue of terrorism and national security in a different resolution. Margolis stated he thanks the Council for its deliberations and considerations about the ordinance amending Whatcom County Code Title 11, Boating and Swimming, to limit the use of limb- propelled flotation devices on the South Fork of the Nooksack River from June 1 through October 31 (AB2005- 173A). He hopes they will work out the technicality of access to the river. PUBLIC HEARINGS 1. ORDINANCE AUTHORIZING THE LEVY OF TAXES FOR COUNTY AND STATE PURPOSES IN WHATCOM COUNTY, WASHINGTON, FOR THE YEAR OF 2006 PURSUANT TO HOME RULE CHARTER SECTION 6.10 (AB2005 -426) Caskey- Schreiber opened the public hearing and, hearing no one, closed the public hearing. Brenner moved to adopt the ordinance. They are not raising taxes this year. This is the status quo. Motion carried unanimously. 2. He appreciates the administrations budget control, constraint, and planning. RESOLUTION TO SET HEARING TO SELL SURPLUS PROPERTY BY AUCTION, REQ. #03 -05 (AB2005 -390B) OTHER ITEMS 3. ORDINANCE AMENDING THE 2005 WHATCOM COUNTY BUDGET, REQUEST #12, IN THE AMOUNT OF $923,766 (AB2005 -430) Nelson reported for the Finance and Administrative Services Committee and moved to adopt the ordinance. Motion carried unanimously. 1. ORDINANCE AMENDING WHATCOM COUNTY CODE TITLE 11, BOATING AND SWIMMING, TO LIMIT THE USE OF LIMB - PROPELLED FLOTATION DEVICES ON THE SOUTH FORK OF THE NOOKSACK RIVER FROM JUNE 1 THROUGH OCTOBER 31 (AB2005 -173A) McShane reported for the Natural Resources Committee and stated a substitute ordinance will be introduced and discussed at the December 6, 2005 Council meeting. Brenner stated that at some point, access 250 feet north of the Acme Bridge was removed. That was a logical request. It's appropriate for people to enter the river right around the bridge. That 250 feet gave people space to enter the river around the bridge. Roy stated Councilmember McShane made the motion to remove it. Staff also said it wasn't a good idea. McShane stated he was convinced it was not a good idea to leave the language in. The committee agreed to withdraw it. Nelson stated he thought staff was concerned about access. Crawford stated there is no access there. Brenner stated the access issue was why they needed to allow 250 feet north of the bridge. Someone told her today that a staff person wanted it that way. She would like that language back in the ordinance. If the Council decides to remove it at the next meeting, the Council can still vote on the ordinance because it won't be a substantial change. McShane stated he will not support it now. Brenner stated she agreed with Councilmember Fleetwood. Put it in now. After the hearing, they can remove it if they want to. This is not unreasonable to request. Brenner moved to amend the ordinance to include the access 250 feet north of the bridge. McShane stated they don't want to go north of the bridge. They want to go south of the bridge. Bruce Roll, Assistant Director, stated this has to do with the issue of access at the Betty Lou Close place. They need to consider whether they want access at that location. It's not zoned for a lot of parking. There is limited parking now. Also, there is an application for the location to be a conservation reserve enhancement program (CREP) area. Brenner stated she was extremely involved in the purchase of the Betty Lou Close property. All the public wanted to make sure there was public access to the river and doing picnicking. CREP projects are great, but that property must have public access. It's a beautiful piece of property when it's not flooding. Roy asked about the parking limitation, which is a huge issue now. Roll stated he believes it is zoned agricultural. If they were going to increase the parking, they could expand to 20 or 30 cars. It's not designed for it. This doesn't prevent the use for other beneficial uses, such as access for fishing. There is no intent to close it off. People do use the property. Now, the question is whether it would be an access point for the activities they are talking about. McShane stated read from the minutes of the meeting where this language was removed (on file). The County needs to figure out how to manage that property in the future. Brenner asked if the area is north of the bridge. Roll stated the Betty Lou Close property is south of the bridge. They are talking about an area south of the bridge that doesn't have good access within that 200 foot mark. The sandbar is farther down the property. There is an old channel that goes through there. One concern is whether that access will be eliminated because of water moving down there. However, if there was ever a place that was perfect for public access and other uses, it would be this property. The Betty Lou Close property is perfect for all kinds of public use. Roy stated she will not support the amendment. They should provide public access. However, she's concerned the area will be taken over with the inner - tubing activity. There is no way that parking lot can hold the number of cars that use the river. They might actually end up decreasing some of the softer recreational activities such as picnicking. If there are hundreds or a thousand people going down on the river from that one place in one day, the area will no longer be attractiveness for other casual recreational users. Caskey- Schreiber stated she will also not support the amendment. She supports the Parks Department and Paula Cooper's efforts to do restoration at that location. The worst thing they could do is channel the access through that area. Motion to amend failed 1 -6 with Brenner in favor. Caskey- Schreiber stated the ordinance will have a public hearing on December 6, 2005. 2. RESOLUTION AUTHORIZING THE WHATCOM COUNTY EXECUTIVE TO PURCHASE DEVELOPMENT RIGHTS ON PAUL DAIRY PROPERTY (AB2005 -432) McShane reported for the Natural Resources Committee and moved to approve the resolution. Caskey- Schreiber stated she was thrilled to see this project. It's in an area likely to experience a lot of growth pressures. The purchase of development rights (PDR) acquisitions will be key in the future in creating a border for rural areas, so they can keep the agricultural industry viable. She thanked Planning Director Hal Hart for giving Senior Planner Kraig Olason the freedom to pursue the highly complicated acquisitions. Motion carried unanimously. 4. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING ORDINANCE, WCC TITLE 20, CHAPTER 20.71 — WATER RESOURCE PROTECTION OVERLAY DISTRICT AND CHAPTER 20.97 — DEFINITIONS TO PROVIDE ADDITIONAL REGULATORY PROTECTION FOR THE LAKE WHATCOM AND LAKE SAMISH WATER RESOURCE PROTECTION OVERLAY DISTRICTS (AB2005 -425) Fleetwood reported for the Planning and Development Committee and moved to adopt the ordinance with one amendment recommended by the Whatcom County Council, 11/22/2005, Page 9 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 DISCLAIMER: This document contains the Whatcom County Council or Committee minutes, as approved. Brenner stated the amendment is to make it clear that already existing uses are nonconforming uses that would be allowed to continue. Crawford asked if a certain citizen in the watershed would have to give up her horses. Brenner stated she would not. It is allowed if it already exists. Crawford stated horses come and go. Brenner stated that's what the property is being used for. Crawford asked if another person with the same size property could not have horses. Someone indicated that is correct. Brenner stated the County does this all over the county when the rules change. There are all kinds of things that are grandfathered in because they already exist. Motion carried unanimously. APPROVAL OF THE 2005 COMPREHENSIVE PLAN AMENDMENTS 1. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY COMPREHENSIVE PLAN MAP AND THE WHATCOM COUNTY ZONING MAP FROM SUBURBAN ENCLAVE /RR2 TO PUBLIC RECREATION /ROS FOR APPROXIMATELY 47 ACRES WITHIN THE CHUCKANUT -LAKE SAMISH SUBAREA (AB2005 -084A) Fleetwood moved to adopt the ordinance. Motion carried unanimously. 2. ORDINANCE AMENDING THE WHATCOM COUNTY COMPREHENSIVE PLAN RELATING TO TRANSPORTATION IMPACT FEE BACKGROUND INFORMATION (AB2005 -084C) McShane moved to adopt the ordinance. Motion carried unanimously. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY COMPREHENSIVE PLAN MAP AND THE WHATCOM COUNTY ZONING MAP FOR APPROXIMATELY TWO ACRES WITHIN THE SOUTHERN UGA BOUNDARY FOR LYNDEN (AB2005 -084D) it. McShane moved to adopt the ordinance. Nelson asked if this is based on the recommendation of the City of Lynden. Crawford stated the City of Lynden opposed this. The landowner applied for Caskey- Schreiber stated there was a modification. McShane stated the City, applicant, and County all agreed on this ordinance. Troy Holbrook, Senior Planner, stated all parties agreed to this ordinance. (Clerk's Note: End of tape one, side A.) Brenner stated she recalled that this application was rejected as a Comprehensive Plan amendment and approved as a rezone. Holbrook stated that was part of it. There were two amendments. One amendment was to take it out of the UGA. The other amendment was to rezone it. It was left in the UGA, and part of the rezone went through. It was part of the Comprehensive Plan docket. Crawford stated the City of Lynden recommended that the County deny removal from the UGA for five reasons. McShane stated it is still in the UGA. Brenner moved to adopt the ordinance. Motion carried unanimously. McShane moved to approve all three ordinances concurrently Motion carried unanimously. REPORTS AND OTHER ITEMS FROM COUNCILMEMBERS Brenner stated Sustainable Connections recently held a workshop on solar energy. In this area, people who collect solar energy can sell it back to Puget Sound Energy. The County should look into that program. There was a Pro - Whatcom meeting last night with a presentation by John McLaughlin. She would like to get that presentation and a workshop on how to do this new method on population projections and growth management. He will work on new ideas with the Whatcom Alliance for Healthcare Access. Roy stated the County funds the Nooksack Salmon Enhancement work crews, it's nice to see their work pay off. Salmon are returning in good numbers to Terrell Creek for the first time in years. Brenner stated that she and Councilmember Caskey- Schreiber also attended the Salmon Summit this year. It was extremely interesting and educational. She asked Councilmember Nelson about a letter of support on mental health. The Council needs to write this letter as soon as possible, or the whole program could be eliminated. Nelson stated the State Department of Social and Health Services (DSHS) has made a determination on how to interpret legislative action.
