p.m. in the Council Chambers, 311 Grand Avenue, Bellingham, Washington.

017)
Pete Kremen, County Executive, presented (on file) and read from his State
of the County address.
Caskey - Schreiber thanked Executive Kremen. It's a unique situation where
they both support each other. The county benefits. She is proud to be a part that.
2. PROCLAMATION BY EXECUTIVE KREMEN DECLARING JUNE 2005 AS

OPEN SESSION
The following people spoke:
Dennis Jones 1487 Sudden Valley, stated a ban is sought on riding inner
tubes on the South Fork of the Nooksack River. Chinook runs are down on the
Nooksack River. The Lummi Nation is doing a wonderful job. He thanked the
County for putting in a trail at Skookum Creek.
The number of Coho is up. It spends time in the more brackish water.
Working together on stewardship works. Don't have a blanket ban on riding inner
tubes. There may be an area on the South Fork that people can see. Leave an
exception open. The Northwest Ecosystem Alliance, Building Industry Association,
Sudden Valley, and all are working together.
Doug Ravel, 817 - 25th Street, Apt. Al, Bellingham, stated the Council should
approve a resolution supporting the establishment of a Department of Peace at the
federal level. He proposed a resolution.
Ban the sale of tobacco in Whatcom County. The tobacco industry is a
criminal enterprise. It kills about 400,000 each year in the United States and adds
misery to all citizens. Take a stand against the industry.
Last, vigorously prosecute people who litter. When he walks, he picks up as
much litter as he can. By removing litter, it helps prevent the next person from
thinking the area is a garbage can.

moved to adopt the ordinance.

3. REQUEST CONFIRMATION OF THE EXECUTIVE'S APPOINTMENT OF
ANARA THOMAS TO THE ANIMAL CONTROL ADVISORY COMMITTEE
(AB2005 -264)
Fleetwood moved to confirm the appointment.
Motion carried unanimously.
4. REQUEST CONFIRMATION OF THE EXECUTIVE'S REAPPOINTMENT OF
GIL THURSTON, BILL KEOWN, AND ALAN FRIEDLOB TO THE
NORTHWEST SENIOR SERVICES BOARD (AB2005 -265)
Roy moved to confirm the reappointments.

Crawford voted for Eugene Roberts. He has concerns about a conflict of
interest with Jacklyn Rossing. They need to avoid an appearance of a conflict.
McShane voted for Jacklyn Rossing. He is very concerned about the water
district.
Fleetwood voted for Roberts.
Caskey- Schreiber voted for Rossing. The rules according to legal counsel are
clear. If elected, Ms. Rossing will have to recuse herself from any employment
decisions regarding her husband. However, since Ms. Rossing was secretary for a
long time, she has a better understanding of this district than most people.
Brenner voted for Rossing. She spoke with quite a few people in the area.
They are very impressed with Ms. Rossing. The resumes of both applicants look
fine. Also, this position won't be any different from councilmembers who have jobs
that put them in the same conflict. The issue won't come up very often.
Nelson voted for Roberts. They have two fine candidates to choose from.
The community is very supportive of its water association.
Roy voted for Rossing.
Jacklyn Rossing was appointed 4 -3.
Brenner stated they should send a letter to Mr. Roberts thanking him for
applying and asking him to please apply again. She will write the letter.
INTRODUCTION ITEMS
Brenner reported for the Public Works and Safety Committee on
Introduction Item one. The Council received a substitute version based on changes
made in the Public Works Committee. Lincoln Road is bumped up in priority. Also,
the six year road plan leads people to believe that projects listed will be done in six
years, but that's not the case. They need to make sure people don't have that
misunderstanding. With Mr. Rutan's assistance, the committee recommends
putting into the six -year road plan only those projects that will have some
significant work done on them in the next six years. The project list is much
smaller. She moved to accept the Introduction Items, including the substitute for
Introduction Item one, the six -year transportation improvement program.
Motion carried unanimously.

OTHER BUSINESS
Roy stated she thanked the Public Works Department for putting double
yellow lines along Birch Bay Drive.
REPORTS AND OTHER ITEMS FROM COUNCILMEMBERS
Caskey - Schreiber stated she will ask all the councilmembers to comment on
the possibility of the Economic Development Council to take out a significant loan
for a feasibility study. Councilmember Crawford has the proposal right now.
Roy stated the inner tubing issue (AB2005 -173) has gotten a lot of
attention. The Natural Resources Committee decided a ban is an option to look at.
With the help of legal counsel who is working up an ordinance, they are looking at
floatation devices where peoples' arms and legs hang out. Kicking around causes a
disruption. This is not a done deal. When a draft ordinance is complete, everyone

will have an opportunity to see it and comment on it. The ordinance will be
introduced and there will be a public hearing. It's premature for people to assume
a ban will be adopted. They are opening up a discussion on the issue.
Nelson stated the inner tubing issue has been brought before the Council
before, about ten years ago.
McShane stated he had a conversation with personnel from the State
Department Natural Resources (DNR), Aquatic Lands Division. That person
suggested identifying areas along the rivers. DNR has ownership of aquatic lands.
DNR is interested in allowing access to the river. There may still be swimming
opportunities in areas where endangered Chinook don't frequent. People would still
be able to go to the river and enjoy the warm water.
Brenner asked who the committee heard from on the inner tubing issue.
Roy stated the committee has heard from the State Department of Fish and
Wildlife, Lummi Nation, Nooksack Tribe, Nooksack Salmon Enhancement
Association, National Oceanic and Atmospheric Administration (NOAA), and the
Federal Forest Service. Thanks to Dr. Roll, almost every agency was involved at
the meeting.
Brenner asked if any other rivers that are habitat for endangered species
have had people ride inner tubes.
Caskey- Schreiber stated that is information to discuss at the next meeting.
Caskey- Schreiber stated the Council will have the Washington Community
Economic Revitalization Team (WA -CERT) list (AB2005 -269) on its agenda at
the next meeting.
