Committee Chair Seth Fleetwood called the meeting to order at 3:10 p.m. in the
Council Chambers, 311 Grand Avenue, Bellingham, Washington.

COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL
3. ORDINANCE AMENDING THE OFFICIAL WHATCOM COUNTY ZONING
ORDINANCE, SPECIFICALLY ADDING ON -FARM PROCESSING TO CHAPTER
20.100 — ACCESSORY USES, 20.40.138 — ADMINISTRATIVE USES, DELETING
20.40.158 ADDING AGRICULTURAL PROCESSING DEFINITION TO CHAPTER
20.97 — DEFINITIONS AND ADDING LOT COVERAGE RESTRICTION —
CHAPTER 20.40.450 (AB2006 -282)
Brenner asked if the Council may just vote on it and not remand it to the Planning
Commission.
Karen Frakes, Senior Civil Deputy Prosecutor, stated it should be remanded to the
Planning Commission. It's a substantial change.
Brenner moved to remand to the Planning Commission for additional review. More
zones will be included.
Motion carried unanimously.
1. CONSIDERATION OF THE HEARING EXAMINER'S RECOMMENDED APPROVAL
OF A PROPOSED BINDING SITE PLAN, PLANNED UNIT DEVELOPMENT, AND
A SITE SPECIFIC REZONE FOR "HORIZONS VILLAGE AT SEMIAHMOO" FILED
BY BIRCH POINT VILLAGE, LLC (AB2006 -286)
Karen Frakes, Senior Civil Deputy Prosecutor, stated there is an agreement. The
issue is whether the State Environmental Policy Act (SEPA) appeal should be combined with
the underlying permit and provisions. The SEPA appeal is early in the process. It will not
be before the Council for a couple of months. She suggested that the parties agree to an
expedited appeal process, to procedurally have everything in one package. They have been
able to reach some agreements. If the Council approves, the Council will hear this matter
on September 12. The parties have worked out a briefing schedule.
Doug Robertson, attorney, stated that he speaks on behalf of the applicant. His
client has agreed with great trepidation. This appeal has stalled him for four months. It
has been considerably expensive. This eats up seven weeks of prime construction time.
The connector road is a huge impact to the entire area. If this continues to get delayed,

1 that road can be delayed a considerable period of time due to winter. They are in
2 agreement so procedural issues can be addressed. However, if held today, make sure the
3 SEPA can be heard on September 12, or else do it today.

5 Fleetwood stated they can assure that the SEPA will be held on the 12th. He
6 moved to hold in committee until September 12, 2006.
