10 Council Chair Laurie Caskey - Schreiber called the meeting to order at 6:15 p.m. in
11 the Council Committee Room, 311 Grand Avenue, Bellingham, Washington.

24 1. REQUEST AUTHORIZATION FOR THE EXECUTIVE TO EXECUTE AN EXCHANGE
25 OF QUIT CLAIM DEEDS TO RESOLVE A PROPERTY DISPUTE AND CLEAR THE
26 TITLE FOR BOTH PARTIES (AB2006 -242)

28 Joe Rutan, Public Works Department, stated this is a deed swap to match what is
29 actually out there on the land. Do this openly.

31 Nelson asked if the land the County is swapping for is so the person can have beach
32 closer to his land. Rutan stated their title company showed that their lease and bounds
33 description described the wrong property. Both properties are equivalent. The property the
34 County thought belonged to it is not encumbered by the old dock foundation. People in
35 Birch Bay commonly know which property is the County's. Staff believes it would be best to
36 do it this way.

40 2. DISCUSSION REGARDING MUSHROOM SUBSTRATE LITIGATION (AB2006-

43 Nelson moved to go into executive session for approximately 40 minutes to discuss
44 this item.

46 Motion carried 5 -0 with Fleetwood and Crawford out of the room.
