September 15, 2009
Committee Chair Laurie Caskey- Schreiber called the meeting to order at 3:05 p.m. in
the Council Chambers, 311 Grand Avenue, Bellingham, Washington.
Present: Laurie Caskey- Schreiber, Bob Kelly and Carl Weimer.
Absent: None.
Also Present: Barbara Brenner, Seth Fleetwood, and Sam Crawford.
COMMITTEE DISCUSSION
2. DISCUSSION OF THE 10 -YEAR UGA REVIEW PROCESS (AB2009 -052)
Rebecca Craven, Council Policy Analyst, submitted and read from a handout (on file),
gave a staff report, and explained where specific information is located in the Executive's
proposal. This is in preparation of the joint public hearing with the Planning Commission
scheduled for September 17, 2009.
Discussion included whether there will be discussion or questions from the
councilmembers and commissioners during the public hearing; the urban growth area (UGA)
schedule; whether State law allows urban growth area reserves; the County's role in
facilitating the development of a capital facilities plan from a reluctant jurisdiction; how to
handle a special district that may hijack the development of a capital facilities plan; whether
the County must provide urban services to UGA's if they aren't annexed, and; the
Executive's amended proposal for Birch Bay.
Jack Petree, Caitac, submitted information (on file) and stated the recommendation
doesn't indicate the lands being left out on the maps. The process is troubling because it's
difficult to follow and compare the maps. It's important to provide these maps. If they
don't understand something, they must clarify it. This issue is illustrative of other
difficulties throughout the process. It's often difficult to follow. If the councilmembers don't
understand something, they shouldn't vote on it.
I. ORDINANCE AMENDING, ON AN INTERIM BASIS, THE DEFINITION OF
"PARCEL" IN THE AGRICULTURE PROTECTION OVERLAY (APO) ZONE
(AB2009 -338)
David Stalheim, Planning and Development Services Department Director, gave a
staff report.
Discussion included nominal acreage; whether clustering really protects farmland,
and; whether rights -of -way are the property of the property owner or easement holder.
Weimer moved to recommend approval to the full Council.
The motion carried by the following vote:
Ayes: Caskey- Schreiber, Kelly and Weimer (3)

Weimer moved to recommend forwarding for concurrent review to the full Council.
The motion carried by the following vote:

Nays: None (0)
OTHER BUSINESS
Rebecca Craven, Council Policy Analyst, stated the Lake Whatcom subdivision
application moratorium is on the Council agenda for public hearing and action tonight. She
asked if the Council will want a presentation.
