CALL TO ORDER
Council Chair Sam Crawford called the meeting to order at 1:00 p.m. in the Council
Conference Room, 311 Grand Avenue, Bellingham, Washington.
ROLL CALL
Present: Barbara Brenner, Sam Crawford, Kathy Kershner, Bill Knutzen, Ken
Mann, L. Ward Nelson and Carl Weimer
Absent: None
COMMITTEE DISCUSSION — COUNCIL CONFERENCE ROOM
1. DISCUSSION REGARDING A POTENTIAL PROPERTY ACQUISITION BY THE
WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT (AB2010 -018)
(Clerk's Note: Council acting as the Whatcom County Flood Control Zone District
Board of Supervisors.)
Crawford stated that discussion of agenda item one may take place in executive
session pursuant to RCW 42.30.110 (1)(B). Executive session will conclude no later than
3:00 p.m. If the meeting extends beyond the stated conclusion time, he will step out of the
meeting to make a public announcement.
Nelson moved to go into executive session until no later than 3:00 p.m. to discuss
the agenda item, pursuant to RCW citations as announced by the Council Chair.
The motion carried by the following vote:
Ayes: Brenner, Crawford, Kershner, Knutzen, Nelson and Weimer (6)
Nays: None (0)
Absent: Mann (1) (out of the room)

1. DISCUSSION REGARDING A DRAFT ORDINANCE AMENDING WHATCOM
COUNTY ZONING CODE TITLE 20, THE OFFICIAL WHATCOM COUNTY
ZONING MAP, AND THE WHATCOM COUNTY COMPREHENSIVE PLAN AND
MAPS, TO IMPLEMENT CHANGES RELATING TO RURAL LAND USE PLANNING

The following person answered questions:

There was discussion regarding the origin of policies 2EE -4 and 2GG -11; allowing a
community sewer system in cluster areas that are still considered rural; allowing for
necessary services, such as fire suppression, in rural areas; how to define or measure
cumulative impacts referenced in Policy 2GG -13; removing the permitted use language from
2GG -13; understanding that Policy 2GG -13 recognizes rural character, not addresses
cumulative impacts; the difference between zoning decisions and conditional use decisions;
having some kind of mechanism to measure cumulative impacts; (2:19:18 PM) addressing
vested properties in Policy 2HH -1; whether they can consider vested rights as the build
environment in a limited area of more intense rural development (LAMIRD); including
undeveloped lands in a LAMIRD; allowing a mechanism for common ownership in 1990,
and; common ownership issues in Type II LAMIRD's.
Brenner moved to amend Policy 2EE -4, "Prohibit extension or expansion of
municipal publie sewer systems...."
The motion carried by the following vote:
Ayes: Brenner, Mann, Crawford, Knutzen, Kershner, Nelson and Weimer (7)

Kershner moved to strike 2GG -13,

Kershner moved to amend 2GG -4, "PeFFnitted ttUses and densities within the rural
designation...." (2:17:50 PM)
The motion carried by the following vote:
Ayes: Brenner, Mann, Crawford, Knutzen, Kershner and Nelson (6)
Nays: None (0)
Absent: Weimer (1)
Knutzen moved to amend 2HH- 1(C)(2), "f. Lands in common ownership or owned
by affiliated companies."
Kershner suggested a friendly amendment to amend 2HH -1(2), "...not
intensively developed, including lands in common ownership, may be included ..."
Knutzen did not accept the friendly amendment.
The motion failed by the following vote:
Ayes: Crawford and Knutzen (2)
Nays: Brenner, Mann, Kershner and Nelson (4)

Kershner moved to delete Policy 2GG- 2(A)(1).
Crawford suggested a friendly amendment to amend Policy 2GG- 2(A)(1), "1.

Kershner accepted the friendly amendment.
