ROLL CALL (1:51:47 PM) Present: Barbara Brenner, Ken Mann and Tony Larson. Absent: None. Also Present: Bill Knutzen. COMMITTEE DISCUSSION 1. RESOLUTION ADOPTING THE 2012 ANNUAL ROAD CONSTRUCTION PROGRAM (AB2011 -309) Joe Rutan, Public Works Department, gave a staff report and stated there needs to be one change to the annual construction program (ACP), per the memo on Council packet page 230. Also, the recently- approved Lummi lease requires the placement of a pedestrian project for construction of sidewalks on the six -year plan. He submitted a revised annual construction program (on file). He described the additional pedestrian project required by the ferry lease. He will bring forward a revised six -year plan that reflects this substitute. The following people answered questions: • Chris Brueske, Public Works Department • Jim Karcher, Public Works Department Brenner stated and there was discussion of: • The lease commitment given diminishing road funds. • Not knowing exactly what the pedestrian project will be. • Whether the Council will be able to approve or not approve the pedestrian project. • Whether the Council could approve the original version of the ACP, without the pedestrian project. She suggested language for the project narrative, "This project is in fulfillment of the ferry lease obligation. This project will construct pedestrian facilities such as sidewalks, separated paths and /or shared use shoulders among other non - motorized improvements, if there is mutual agreement." Larson stated they should use the language from the lease or reference the lease. Mann asked and there was discussion of: • Expenditures to -date on Lincoln Road. • The local contribution of $1.45 million for the Birch Bay Lynden /Portal Way signalization. Brenner moved to amend to remove item six and to go back to the original ACP as shown on Council packet pages 232 and 233. Larson stated they are contractually obligated to that item. Brenner withdrew her motion. Mann moved to recommend introduction of the substitute annual construction program to the full Council. He moved to amend to remove Item 21, CRP #905003, Slater Road /Nooksack River Bridge. He vowed to never vote for this project again. The motion to amend carried by the following vote: Ayes: Brenner, Mann and Larson (3) Nays: None (0) The motion to approve the substitute as amended carried by the following vote: Ayes: Brenner and Larson (2) Nays: Mann (1) Brenner asked and there was discussion of the higher estimate for the Birch Bay Lynden /Portal Way signalization project. (2:28:14 PM) Brenner moved to reconsider the motion to approve the substitute as amended. The motion to reconsider carried by the following vote: Ayes: Brenner, Mann and Larson (3) Nays: None (0) Mann moved to amend to remove the Birch Bay Lynden Portal Way signalization, item two. The motion to amend failed by the following vote: Ayes: Mann (1) Nays: Brenner and Larson (2) The motion to approve as amended carried by the following vote: Ayes: Brenner and Larson (2) Nays: Mann (1) OTHER BUSINESS Knutzen asked and there was discussion of whether the Council can discuss the Hazard Mitigation Plan (AB2011 -293) and (AB2011 -294) after the hearing.
