CALL TO ORDER
Council Chair Sam Crawford called the meeting to order at 5:30 p.m. in the Council
Conference Room, 311 Grand Avenue, Bellingham, Washington.
ROLL CALL
Present: Barbara Brenner, Sam Crawford, Kathy Kershner, Bill Knutzen, Ken
Mann, Tony Larson and Carl Weimer
Absent: None
1. DISCUSSION REGARDING POTENTIAL PROPERTY ACQUISITION FOR THE
FLOOD CONTROL ZONE DISTRICT (AB2011 -341) (COUNCIL ACTING AS THE
WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT BOARD OF
SUPERVISORS)
2. DISCUSSION WITH SENIOR DEPUTY PROSECUTOR KAREN FRAKES
REGARDING PENDING LITIGATION (AB2011 -018)
3. DISCUSSION REGARDING POTENTIAL LITIGATION (AB2011 -018)
Crawford stated that discussion of agenda item one may take place in executive
session pursuant to RCW42.30.110(1)(b) and discussion of agenda items two and three
may take place in executive session pursuant to RCW42.30.110(1)(i). Executive session
will conclude no later than 7:00 p.m. If the meeting extends beyond the stated conclusion
time, he will step out of the meeting to make a public announcement.
Knutzen moved to go into executive session until no later than 7:00 p.m. to
discuss the agenda items, pursuant to RCW citations as announced by the Council Chair.
Crawford stated that regarding item three, he is only present at the meeting to
discuss with the attorney whether executive session is appropriate. If the attorney feels
that it is not appropriate, he may step out of the meeting during discussion of the item.
The motion carried by the following vote:
Ayes: Brenner, Crawford, Kershner, Knutzen, Mann, Larson and Weimer (7)
Nays: None (0)
