ROLL CALL Present: Barbara Brenner, Ken Mann, Sam Crawford, Kathy Kershner, Carl Weimer and Pete Kremen. Absent: Bill Knutzen. COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL 1. DRAFT PUBLIC PARTICIPATION PLAN (AB2012 -222) Mann moved to recommend approval of the plan to the full Council. Matt Aamot, Planning and Development Committee, answered questions. Mann asked and there was discussion of whether any suggestions from David Stalheim were incorporated into this version. Kershner referenced level two projects. She stated and there was discussion of: • Making sure they're saying the population analysis is new, based on current Census figures, as they go forward. • Taking another look at this using the new and improved population analysis, feedback, and comment. The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner, Weimer and Kremen (6) Nays: None (0) Absent: Knutzen (1) COMMITTEE DISCUSSION 1. ORDINANCE AMENDING WHATCOM COUNTY CODE TITLE 20, THE OFFICIAL WHATCOM COUNTY ZONING MAP, AND THE WHATCOM COUNTY COMPREHENSIVE PLAN AND MAPS, TO IMPLEMENT CHANGES RELATING TO RURAL LAND USE PLANNING (AB2012 -193) Gary Davis, Planning and Development Committee, gave a staff report and submitted and read from a presentation (on file). Davis concluded the presentation. Crawford asked and there was discussion of what lot coverage issue they must address outside the watershed, per the Hearings Board. Kershner asked and there was discussion of whether one of the issues was visual compatibility. (1:44:13 PM) Brenner moved to amend the table headings in section 20.80.100 to delete the current headings and change the columns to commercial, industrial, and mixed use. The mixed use category would be all or some that existed in 1990. Crawford asked to hear from Mr. Swanson about his recommendations for the categories. Jack Swanson, attorney, referenced a letter he wrote to the Council. He referenced and there was discussion of the categories listed in RCW 36.70A.070(5)(d)(i), commercial, industrial, residential, and mixed -use. Use those four categories instead of the eight proposed categories. Brenner withdrew her motion. Kershner stated she would like to delete the table in 20.80.100 and allow uses compatible with what existed July 1, 1990. Kershner moved to amend language, page 10 of 89, 20.59.050, "in a Rural Gengn9unity designatien, uses listed belew aFe peFmitted if a use ef the sange type existed iR that designation en july 1, 1990, peF WGG 20.80.190(l). In a Rural Community designation, uses are permitted if the use is consistent with the character of the area on July 1, 1990, considering size, scale, use, or intensity. In a Rural Business designation all uses are permitted." Put the onus on the applicant to show that a use meets size, scale, use and intensity. The Committee discussed the motion. Gary Honcoop, Planning Commissioner, discussed the issue of whether public services are required. The question is how to define size, scale, use, and intensity. Kershner withdrew her motion. Brenner moved to return the table in 20.80.100 to the Planning Commission recommendation, before the Council made changes on June 8, and to amend the heading for the table, "Maximum fleeF aFea peF building, On square fe Maximum combined floor area of all buildings, in square feet." The Committee discussed the motion. The motion failed by the following vote: Ayes: Brenner and Mann (2) Nays: Crawford, Kershner and Kremen (3) Absent: Weimer and Knutzen (2) Special Committee of the Whole, 6/19/2012, Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 Kershner moved to delete the table in 20.80.100, use it as a reference, and use the proposed language from the Planning Commission in March that would allow administrative approval of applications that don't immediately meet the threshold. (2:26:08 PM) She stated the motion puts the onus on the applicant to show the application meets the 1990 built environment criteria. The Committee discussed the motion. Heather Wolf stated they've added language to the conditional use process that would address those concerns. Kershner withdrew her motion. She moved to amend 20.80.100(2) on page 86 of 89 of Exhibit B, the zoning code, to add language, "Modifications to building sizes and uses in Rural Communities." The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner and Kremen (5) Nays: None (0) Absent: Weimer and Knutzen (2) Kershner moved to amend 20.80.100(2)(b), to ask Planning staff to add language regarding a change of use appropriately in that section to allow more flexibility for use. Davis suggested language similar to, "Within a rural community designation, development or redevelopment ... or development or redevelopment of a use other than shown in 20.80.100(1) and or building sizes greater than ... Such a conditional use permit der building si is subject to the finding that...." The Committee discussed the motion. Davis stated he will work on that language before evening meeting. The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner, Weimer and Kremen (5) Nays: None (0) Absent: Weimer and Knutzen (2) (2:50:19 PM) Kershner moved to amend 20.80.100(2)(b)(1), "The larger use or building size will not cause...." The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner and Kremen (5) Nays: None (0) Absent: Weimer and Knutzen (2) Davis referenced a suggestion from Roger Almskaar regarding page 4 of 89 of the draft zoning code, section 20.32.253, "...allowed within Rural Neighborhoods and Rural Commercials, as outlined in the Comprehensive Plan: RR -2A, RR- 1...." Kershner moved to combine restaurant and lodging in the table in section 20.80.100(1). The Committee discussed the motion. The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner and Kremen (5) Nays: None (0) Absent: Weimer and Knutzen (2) Kershner moved to combine manufacturing and fabrication with salvage in the table in section 20.80.100(1). The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner and Kremen (5) Nays: None (0) Absent: Weimer and Knutzen (2) Kershner moved to clarify in the code they're talking about non - residential uses when referring to the chart, and ask Planning staff to include that language. The motion carried by the following vote: Ayes: Brenner, Mann, Crawford, Kershner and Kremen (5) Nays: None (0) Absent: Weimer and Knutzen (2) Crawford asked and there was discussion of lot coverage. The following people spoke: • Gary Honcoop, Planning Commission • Linda Twitchell, Building Industry Association of Whatcom County Crawford referenced and there was discussion of issue 22. (3:19:58 PM) Kershner asked and there was discussion of how the Wild and Scenic River Act designation may affect the size of the type II limited area of more intense rural development (LAMIRD). Crawford asked and there was discussion of a Planning Commission change to the Smith, Axton, and Guide Meridian area. OTHER BUSINESS There was no other business.
