ROLL CALL Present: Barbara Brenner, Sam Crawford, Kathy Kershner, Bill Knutzen, Ken Mann, Pete Kremen and Carl Weimer Absent: None COMMITTEE DISCUSSION (3:01:38 PM) (Clerk's Note: The Committee discussed the agenda items collectively. Review of Interlocal Agreements between Whatcom County and Cities (AB2011- 340)). Matt Aamot, Planning and Development Services Department, gave a staff report. He described the changes to each section. The following people answered questions: • Amy Harksell, City of Lynden • Peter Gill, Planning and Development Services Department • Roxanne Michaels, Planning and Development Services Department • Greg Aucutt, City of Bellingham • Jack Louws, County Executive Kremen asked and there was discussion of the difference in the sales tax revenue sharing formula in Section 10. Mann asked and there was discussion of an agreement to change the development offsite mitigation, and if that requires a change in the critical areas ordinance. Brenner asked and there was discussion of whether offsite mitigation should be in the same watershed. Crawford asked and there was discussion of whether the County is considering putting resources into an actual program. Kremen stated and there was discussion of tying the concept to the Cities making the same commitment to creating receiving areas for transfers of development rights (TDRs). He asked and there was discussion of whether a City could delay annexation so it would not have to absorb the costs. Crawford asked if the County would do any street projects in the urban growth area (UGA) that aren't up to City standards. Kershner referenced Section 2(I)(i -ii) of the Bellingham agreement. She asked and there was discussion of how that area becomes developed enough that citizens could petition that the area be annexed. Brenner stated and there was discussion of not eliminating the Boundary Review Board. She moved to eliminate the language about the Boundary Review Board, as shown in Section 3A in the Bellingham agreement. Crawford asked and there was discussion of what happens if a group of citizens in an area want to form a city and there isn't a Boundary Review Board. Kremen suggested a friendly amendment to amend language as shown in Section 3A of the Bellingham agreement, "...for resolving disputes. As a result, the City and County agree to jointly review with the other jurisdictions and service providers the potential for modifying the role of the BRB in the annexation process the need feF Fetaining Brenner accepted the friendly amendment. The motion carried by the following vote: Ayes: Kremen, Crawford, Brenner, Weimer, Mann and Kershner (6) Nays: None (0) Absent: Knutzen (out of the room) (1) Brenner moved to request that staff modify the same sentence in all the agreements. The motion carried by the following vote: Ayes: Kremen, Crawford, Brenner, Weimer, Mann and Kershner (6) Nays: None (0) Absent: Knutzen (out of the room) (1) Kremen commended staff and all the Cities for collaboratively working on these agreements. Aamot stated have a public hearing at the last meeting in March. Crawford asked and there was discussion of: • The County's adoption of City development standards. • Examples of development standards that are different between the City and the urban growth area (UGA). • What the City of Bellingham intends to do regarding transfers of development rights. Mann asked and there was discussion of how zoning changes as a result of annexation into the City. Crawford referenced section 5.B. He asked and there was discussion of whether the section is binding. Kremen referenced and there was discussion of transfer of development rights receiving areas that have a high value, and the Lake Whatcom watershed. 1. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BELLINGHAM AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE BELLINGHAM URBAN GROWTH AREA (AB2011 -340A) 2. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF BLAINE AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE BLAINE URBAN GROWTH AREA (AB2011- 340B) 3. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF EVERSON AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE EVERSON URBAN GROWTH AREA (AB2011- 340C) 4. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF FERNDALE AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE FERNDALE URBAN GROWTH AREA (AB2011 -340D) S. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF LYNDEN AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE LYNDEN URBAN GROWTH AREA (AB2011- 340E) 6. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF NOOKSACK AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE NOOKSACK URBAN GROWTH AREA (AB2011 -340F) 7. DISCUSSION OF AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SUMAS AND WHATCOM COUNTY CONCERNING PLANNING, ANNEXATION AND DEVELOPMENT WITHIN THE SUMAS URBAN GROWTH AREA (AB2011- 340G) OTHER BUSINESS There was no other business.
