ROLL CALL Present: Ken Mann, Carl Weimer and Sam Crawford. Absent: None. Also Present: Barbara Brenner, Pete Kremen, Kathy Kershner and Bill Knutzen. SPECIAL ORDER OF BUSINESS 1. NOMINATION AND APPOINTMENT OF COMMITTEE CHAIR (AB2012 -021) Weimer moved to appoint Ken Mann. The motion carried by the following vote: Ayes: Mann and Weimer (2) Nays: None (0) Absent: Crawford (1) COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL 1. ORDINANCE AMENDING THE 2012 WHATCOM COUNTY BUDGET, FOURTH REQUEST, IN THE AMOUNT OF $1,189,558 (AB2012 -039) Weimer moved to recommend approval to the full Council. He asked and there was discussion of whether the contracts for drug court was discussed by the advisory committee. The following person answered questions: • Dave Reynolds, Superior Court Clerk The motion carried by the following vote: Ayes: Mann and Weimer (2) Nays: None (0) Absent: Crawford (1) 2. He asked and there was discussion of the definition of official County business. Brenner asked and there was discussion of: • Whether invitations to events are considered County business. • Setting up folders for Council business on councilmembers' personal computers. • Combining items one and three, and removing the first sentence of number three. • Working with her America Online (AOL) personal account. Weimer asked and there was discussion of whether County staff can assist Councilmember Brenner with integrating her AOL account. Brenner stated and there was discussion of: • Deleting the first sentence in item nine. • Combining items ten and 11 into item 12. • Whether there is a State rule that prohibits blind copies, as referenced in item 11. Knutzen suggested that they delete item 11. Mann moved to amend, , 12. Metadata associated with electronic documents, such as the "to" and "from" fields in an email, will be retained with the original email message, including blind copies, and is a public record subject to disclosure upon request." Weimer asked and there was discussion of how easy it is to find emails to people when they're blind- copied on an email. Mann withdrew his motion to amend. Weimer moved to amend language in item 11, 11. Blind cepying (be) ernails is lists. The use of blind copying emails is highly discouraged, including the use of blind distribution lists. A blind copy is a public record subject to public disclosure under the Open Public Records Act." Kremen asked and there was discussion of whether blind copies are required to be disclosed. Weimer moved to amend to add an item to 13, "g. Pornography." The motion to amend carried by the following vote: Ayes: Mann, Crawford and Weimer (3) Nays: None (0) Mann stated and there was discussion of removing all the enumerated items in item 13 and instead referencing the County email policy and Council handbook. Weimer asked and there was discussion of addressing things such as text messages and blogs. The motion to approve as amended carried by the following vote: Ayes: Mann, Crawford and Weimer (3) Nays: None (0) 3. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO AN INTERLOCAL GRANT AGREEMENT BETWEEN WHATCOM COUNTY AND BELLINGHAM TECHNICAL COLLEGE UTILIZING EDI PROGRAM FUNDING FOR USE IN THE CONSTRUCTION PROJECT KNOWN AS BTC'S NORTHWEST CENTER FOR ENVIRONMENTAL, FISHERIES AND AQUACULTURE SCIENCES, IN THE AMOUNT OF $400,000 (AB2012 -046) item. Crawford moved to recommend approval to the full Council. Brenner asked and there was discussion of whether the County already approved this The motion carried by the following vote: Ayes: Mann, Crawford and Weimer (3) Nays: None (0) COUNCIL "CONSENT AGENDA" ITEMS 1. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT BETWEEN WHATCOM COUNTY AND WHATCOM LAND TRUST FOR AUTHORIZATION OF PURCHASE OF A CONSERVATION EASEMENT UNDER WCC 3.25A — PURCHASE OF AGRICULTURE DEVELOPMENT RIGHTS PROGRAM, IN THE AMOUNT OF $2,000 PER EASEMENT, OR 3% FEE ON THE FIRST $150,000 OF THE EASEMENT PRICE, WHICHEVER IS GREATER, AND 2% OF THE EASEMENT PRICE IN EXCESS OF $150,000 UP TO $500,000, AND 1% OF THE EASEMENT PRICE IN EXCESS OF $500,000 (AB2012 -047) (11:49:52 AM) Weimer moved to recommend approval to the full Council. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT BETWEEN WHATCOM COUNTY AND WINDWARD ENVIRONMENTAL CONSULTANTS, LLC FOR ASSISTANCE WITH NPDES PHASE II STORMWATER PERMIT PUBLIC EDUCATION OUTREACH AND EVALUATION, IN THE AMOUNT OF $59,995 (AB2012 -048) (12:00:01 PM) Crawford moved to recommend approval to the full Council. Weimer stated and there was discussion of adding more County staff time to do this type of educational outreach. Brenner stated and there was discussion of why the Cooperative Extension can't do something like this. The following person answered questions: • Chip Anderson, Public Works Department Brenner asked and there was discussion of the funding source and grant requirements. Kremen stated the title should indicate the correct name of Conoco Phillips 66. The motion carried by the following vote: Ayes: Mann, Crawford and Weimer (3) Nays: None (0) OTHER BUSINESS Mann stated and there was discussion of exploring the possibility of purchasing and contracting locally.
