CALL TO ORDER
Committee Chair Ken Mann called the meeting to order at 11:00 a.m. in the Council
Chambers, 311 Grand Avenue, Bellingham, Washington.

Present: Ken Mann, Sam Crawford and Carl Weimer.
Absent: None.
Also Present: Barbara Brenner, Pete Kremen, Kathy Kershner, and Pete Knutzen.
COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL
1. ORDINANCE AMENDING THE 2012 WHATCOM COUNTY BUDGET, ELEVENTH
REQUEST, IN THE AMOUNT OF $153,186 (AB2012 -258)
Weimer moved to recommend approval to the full Council.
Jeff Parks, Sheriff's Office, answered questions.
Mann asked and there was discussion of the reason of the cost of the item to fund
acquisition of two patrol and detection canines.

Brenner stated she likes the drug task force and how they deal with hard drugs, but
she doesn't want to focus any money on marijuana.

medical marijuana operations.
Crawford stated and there was discussion of whether a federal approach is effective,
and whether not approving the funds would send a message to the County Sheriff's Office
about not focusing on this issue.

Mann asked and there was discussion of the other sources of funding that pay for
these efforts.
Brenner stated focus on and reprioritize other drugs such as methamphetamine.
Kremen asked and there was discussion of whether the federal agencies prosecute
any case involving a value of less than $250,000, and the impact to local jurisdictions for
prosecuting cases under that threshold.
Kershner stated the two issues are how they should pursue growing operations and
particularly operations in public lands.
Weimer asked and there was discussion of whether the County, as a member of the
task force, is contractually required to be a part of these efforts.
Crawford asked and there was discussion of an operation in Newhalem recently and
how often similar operations are pursued. Possibly consider doing a resolution to find out
where the Council stands on this issue.

2. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A
CONTRACT BETWEEN THE WHATCOM COUNTY FLOOD CONTROL ZONE
DISTRICT AND THE WATERSHED COMPANY FOR CONSULTANT SERVICES TO
PERFORM HYDRAULIC MODELING, HABITAT ANALYSIS AND CONCEPTUAL
DESIGN OF ALTERNATIVES IDENTIFIED IN THE LOWER NOOKSACK
COMPREHENSIVE FLOOD HAZARD MANAGEMENT PLAN FOR REACH 1
DOWNSTREAM OF FERNDALE, IN THE AMOUNT OF $320,000 (AB2012 -259)
Weimer moved to recommend approval to the Flood Control Zone District Board of
Supervisors.
Paula Cooper, Public Works Department, answered questions.
Mann asked and there was discussion of how many bids or applications the County
received.
Knutzen asked and there was discussion of whether the Recreation and Conservation
Office (RCO) will reimburse the flood control fund.

PREPARATION OF AN EIS ANALYSIS OF THE SWIFT CREEK MANAGEMENT

Weimer asked and there was discussion of whether they are making the same
selections as they have in the past.
Brenner asked and there was discussion of whether or not this is going on the ballot
and examples of how the money has been used in the past. Make sure this doesn't obligate
the County to federal requirements that the County doesn't want.
Kershner asked and there was discussion of which counties participate in the local
resource advisory committee (RAC).

Brenner stated don't use real estate excise tax (REET) funds. Use money from the
park improvement fund.
