CALL TO ORDER
Committee Chair Bill Knutzen called the meeting to order at 2:03 p.m. in the Council
Chambers, 311 Grand Avenue, Bellingham, Washington.
ROLL CALL

Present: Ken Mann, Bill Knutzen and Barbara Brenner.
Absent: None.
Also Present: Pete Kremen.
COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL
1. ORDINANCE AMENDING WHATCOM COUNTY CODE 21.05.039, PHASING,
EXPIRATION, AND TIME EXTENSION FOR PRELIMINARY LONG
SUBDIVISION APPROVAL (AB2013 -272)
Amy Keenan, Planning and Development Services Department, gave a staff report
and stated this is to be consistent with the Revised Code of Washington (RCW). The
Planning Commission recommended approval 7 -0.
Brenner moved to recommend approval to the full Council.
The motion carried by the following vote:
Ayes: Mann, Knutzen and Brenner (3)
Nays: None (0)
2. ORDINANCE AMENDING WHATCOM COUNTY ZONING CODE 20.80.630,
STORMWATER AND DRAINAGE, RELATING TO WATER QUALITY AND
STORMWATER MANAGEMENT IN THE BIRCH BAY UGA (AB2013 -273)

Mark Personius, Planning and Development Services Department, gave a staff report
and stated this excludes the Birch Bay urban growth area (UGA) from the 2012 manual
requirements until December 31, 2016, which is consistent with the permit requirements.
The Planning Commission recommends approval.
Knutzen asked and there was discussion of whether they can exempt other areas
that are having the same difficulties, such as areas on Northwest Road. Personius stated
those areas aren't subject to the 2012 Stormwater Manual.

Knutzen stated they are. The national pollution discharge elimination system
(NPDES) permit boundary goes around Ferndale and Bellingham, in areas outside the UGA.
Cathy Craver, Public Works Department, answered questions. If in the phase two
area, they may be subject to this. The Council can recommend exemption. Nothing in the
phase two permit says the County can't exclude those areas until 2016.
Mann asked and there was discussion of why they are exempting this Birch Bay area.
Mike Kershner, Planning and Development Services Department, answered
questions. The exemption gives staff the opportunity to do public education. They get a lot
of building permits from Birch Bay. They just found out Birch Bay would be included a year
ago, and they weren't sure of the boundaries.
Brenner moved to recommend approval to the full Council.
The motion carried by the following vote:
Ayes: Mann, Knutzen and Brenner (3)
Nays: None (0)
Knutzen asked and there was discussion of whether staff is available to help him
develop an ordinance for other areas outside any UGA that are subject to phase two.
Personius stated staff can help.
