CALL TO ORDER
Council Chair Kathy Kershner called the meeting to order at 5:45 p.m. in the Council
Conference Room, 311 Grand Avenue, Bellingham, Washington.

4. DISCUSSION WITH SENIOR DEPUTY PROSECUTOR KAREN FRAKES
REGARDING PENDING LITIGATION, HIRST ET AL V. WHATCOM COUNTY,
GMHB CASE NO. 12 -2 -0013 (AB2013 -018)
Attorney Present: Karen Frakes
Kershner stated that discussion of agenda item one may take place in executive
session pursuant to RCW42.30.140(4)(a) and discussion of agenda items two, three, and
four may take place in executive session pursuant to RCW42.30.110(1)(i). Executive
session will conclude no later than 7:00 p.m. If the meeting extends beyond the stated
conclusion time, she will step out of the meeting to make a public announcement.
Knutzen moved to go into executive session until no later than 7:00 p.m. to
discuss the agenda items pursuant to RCW citations as announced by the Council Chair.
The motion carried by the following vote:
Ayes: Brenner, Kershner, Knutzen, Mann, and Weimer (5)
Nays: None (0)
Absent: Crawford (out of the room) and Kremen (2)

At 7:00 p.m., Chair Kershner announced that the Committee of the Whole would
extend to no later than 7:15 p.m.

The meeting adjourned at 7:10 p.m.
