ROLL CALL (1:32:00 PM) Present: Barbara Brenner, Ken Mann and Pete Kremen. Absent: None. Also Present: Barry Buchanan. COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL 1. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO AN INTERLOCAL AGREEMENT BETWEEN WHATCOM COUNTY AND THE LUMMI NATION FOR CONSTRUCTION, OPERATION, MAINTENANCE AND REPAIR OF HAXTON WAY ROUNDABOUT AND ASSOCIATED PUBLIC APPURTENANCES (AB2014 -167) Dan Gibson, Prosecutor's Office, gave a staff report and stated the project has been initiated by the Lummi Nation. They obtained funding and are finalizing construction plans for this summer. This establishes the ground rules for County and Lummi Nation interaction. He described the right -of -way use designation. Brenner asked why the County wouldn't do this. Gibson stated there is no reason why it wouldn't. Kremen asked the cost of the total project and how much the Lummi Nation was able to secure from the federal government. Robert Pell, Lummi Nation Project Manager, stated the estimate is $1.5 million for the construction cost. The cost is about $2 million when including right -of -way acquisition. Brenner stated the County isn't contributing anything to the cost. Mann stated he loves the roundabout at Kwina Road. He asked if there are plans to construct others. Pell stated they'd like to, but there are no plans or funding at the moment. Mann asked why they chose Smokehouse Road instead if Cagey Road. Pell stated Smokehouse Road is a thoroughfare for tribal members and Lummi Island residents. The police department data indicate there hasn't been one accident at Kwina Road since the roundabout was installed. Pell stated there are elevation challenges there, but engineers say they can make a roundabout work, but it would be costly. Mann moved to recommend approval to the full Council. Gibson stated staff is working out final details. This will give the Executive the go- ahead to execute this agreement when the details are finalized. Kremen asked if this is pass- through and who will have a potential finding for debarment. Gibson stated this is entirely a Lummi Nation project. There will be interaction with County staff, which is reviewing and approving the plans. This agreement establishes the legal framework for that interaction between the two staffs. Brenner asked if the County will do ongoing maintenance. Gibson stated it will, once the project is complete. The motion carried by the following vote: Ayes: Brenner, Mann and Kremen (3) Nays: None (0) Gibson stated it has been a pleasure for the two governments to work together positively. He appreciates that the Lummi Nation approached the County with a similar spirit. OTHER BUSINESS There was no other business.
