Daugert described his concerns with the proposal, which include the activity associated with a used car lot, including financing. He's concerned about uses associated with Elder Road, but not Slater Road, which should remain rural. He doesn't want any more commercial business. This is spot zoning. The concomitant agreement should be very specific about enforcement. He and Mr. Sitkin have generally been in agreement, and they must sit down and deal with it. If necessary, he will oppose it. He doesn't want his neighbor to be a used car lot. The committee discussed whether this rezone would set a precedent for other similar situations. Frakes stated she is concerned about legal precedents, but this rezone sets no legal precedent. Mann moved to recommend to the full Council that the public hearing be continued beyond tonight to give the applicant and neighbors time to negotiate an agreement. The motion carried by the following vote: Ayes: Mann and Brenner (2) Nays: None (0) Abstain: Browne (1) The committee discussed the conditions under which a councilmember should recuse himself or herself from discussion and decision - making.
