CALL TO ORDER
Committee Chair Ken Mann called the meeting to order at 3:00 p.m. in the Council
Chambers, 311 Grand Avenue, Bellingham, Washington.

Present: Rud Browne, Ken Mann and Barbara Brenner.
Absent: None.
Also Present: Carl Weimer, Barry Buchanan and Pete Kremen.
COMMITTEE DISCUSSION
1. DISCUSSION OF PROPOSED ORDINANCE APPROVING A REZONE REQUEST
FOR FIVE ACRES AT THE INTERSECTION OF SLATER ROAD AND ELDER ROAD
FROM NEIGHBORHOOD COMMERCIAL (NC) TO RURAL GENERAL
COMMERCIAL (RGC) (AB2014 -331)
Gary Davis, Planning and Development Services Department, gave a staff report and
referenced the new site plan and additional materials regarding stormwater.
The committee discussed the concomitant agreement.
John Sitkin, applicant attorney, stated he and the applicant would like to have a
meeting with Larry Daugert. Continue the public hearing tonight so they can have that
discussion with Mr. Daugert.
Larry Daugert stated he supports continuing the public hearing tonight. It will be
helpful to have a meeting with Mr. Sitkin.
The committee continued to discuss the concomitant agreement and the ordinance
document regarding compliance, the site plan, and the scope and location of the business.
Browne stated he will recuse himself from discussion and decision given his family's
personal relationship with the Boulos family.

The committee discussed whether it's realistic that the County will be able to enforce
the conditions of the site plan and concomitant agreement and the cost of enforcing the
agreement through Superior Court and any appeals.

Karen Frakes, Prosecutor's Office, answered questions.
Daugert described his concerns with the proposal, which include the activity
associated with a used car lot, including financing. He's concerned about uses associated
with Elder Road, but not Slater Road, which should remain rural. He doesn't want any more
commercial business. This is spot zoning. The concomitant agreement should be very
specific about enforcement. He and Mr. Sitkin have generally been in agreement, and they
must sit down and deal with it. If necessary, he will oppose it. He doesn't want his
neighbor to be a used car lot.
The committee discussed whether this rezone would set a precedent for other similar
situations.
Frakes stated she is concerned about legal precedents, but this rezone sets no legal
precedent.
Mann moved to recommend to the full Council that the public hearing be continued
beyond tonight to give the applicant and neighbors time to negotiate an agreement.
The motion carried by the following vote:
Ayes: Mann and Brenner (2)
Nays: None (0)
Abstain: Browne (1)
The committee discussed the conditions under which a councilmember should recuse
himself or herself from discussion and decision - making.
