ROLL CALL (3:04:24 PM) Present: Ken Mann, Barbara Brenner and Rud Browne. Absent: None. Also Present: None. COMMITTEE DISCUSSION 1. DISCUSSION REGARDING AN APPLICATION TO REZONE FIVE ACRES FROM NEIGHBORHOOD COMMERCIAL (NC) TO RURAL GENERAL COMMERCIAL (RGC) ZONING DISTRICT (AB2014 -331) Gary Davis, Planning and Development Services Department, submitted handouts (on file) and gave a staff report from the staff memo on Council packet page 440. The Committee discussed a letter from Larry Daugert; how the used car sales business was permitted; including the land survey details in the concomitant agreement; a potential lot line adjustment between the Boulos and Jordan properties; the lack of effort by the Planning Department to stop the unpermitted used car lot; uses that support agricultural zones; the different types of rezones; a concomitant agreement not being adequate for taking the place of a map amendment; signage that blocked the intersection visibility; the purpose of the site plan; unpermitted land disturbance; dealing with runoff from a car sales facility, and; whether the County should approve a rezone to permit an unpermitted use. The following citizens spoke: • John Sitkin, attorney and applicant /landowner representative • Larry Daugert • Larry Stoner, representative for Mr. Boulos • Massad Boulos Mann moved to recommend that the Council deny the request, because it allows someone to do something illegal and then ask for a rezone to make the illegal use legal. Mann withdrew his motion and moved to hold in committee for two weeks to gather more information. He is concerned about someone trying to get away from an enforcement action by getting a rezone. The motion to hold in committee carried by the following vote: Ayes: Mann, Brenner and Browne (3) Nays: None (0) Brenner stated she would like more information on the questions that Mr. Daugart asked and who the Planning staff person was that may have indicated to Mr. Boulos that the use was permitted. She would like to see a copy of the used car license. Browne stated he would like to know if there are other options for the owners besides the rezone process. Brenner stated she would like to know if they can include a size agreement. Mark Personius, Planning and Development Services Department, answered questions. OTHER BUSINESS There was no other business.
