SPONSORED BY: Consent PROPOSED BY: Treasurer INTRODUCTION DATE: 3/17/2015 RESOLUTION NO. 2015 -011 TO SELL COUNTY TAX TITLE PROPERTY BY NEGOTIATION REQUEST NO. 2015 -02 1 WHEREAS, RCW 36.35.120 allows the County to sell real estate acquired by tax 2 foreclosure where it is found to be in the best interest of Whatcom County to sell the 3 same; and, 4 WHEREAS, the Whatcom County Property Management Committee 5 recommends the resolution be passed to effectively meet the legal requirement for the 6 disposal by negotiation pursuant RCW 36.35.150(2), when the county legislative 7 authority determines that it is not practical to build on the property due to the physical 8 characteristics of the property or legal restrictions on construction activities on the 9 property. Subject to a covenant to bind; and, 10 WHEREAS, the Whatcom County Property Management Committee 11 recommends the Whatcom County Treasurer enter into negotiations the applicant; and, 12 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price 13 for said unit of property; and, 14 WHEREAS, the Whatcom County Code as well as the state law allows the 15 County to reserve from the sale coal, oil, gas, gravel, mineral, ores, fossils, timber or 16 other resources if the Council finds that it is in the best interest to reserve these; and 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the principal taxes, title search and foreclosure costs, total $916.55 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell: Parcel # 390528.529024.0000 / PID 109276 GOVT LOT 4 Township 39 Range 03E Section 28 By negotiation for no less taxes, interest, penalties and foreclosure costs of 916.55 BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time of sale; and, Page 1 29 BE IT FURTHER RESOLVED that said parcel shall be sold subject to restrictive 30 covenants allowing for imposition of Community Association fees, if any, as set forth in 31 Whatcom County Resolution No. 88 -37; and, 32 BE IT FURTHER RESOLVED that this sale transfers to the owners all coal, oil, 33 gas, gravel, minerals, ores, fossils, timber or other resources on or in said land and the 34 right to mine for and remove the same in conformity with zoning regulations in force and 35 effect; and, 36 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby 37 directed to sell such property at not less than a certified price and said sale shall take 38 place in accordance with the duties as established in RCW 36.35.120. 39 APPROVED this 31st day of March , 2015. 40 .�`Cs " C:1 f, ., WHATCOM COUNTY COUNCIL 41 ATTE$`T, M r " x WHATCOM COUNTY, WASHINGTON f 42 43 Dana= n- Da1yv,+ kQt - acivOierk Carl Weimer, Chair of the Council r f r f ti 44 APPROVEb'A,$1TTQk F,0i C. p 45 46 46 Civi secuting Attorney Page 2
