D(N N Requested Date: Resolution amending Whatcom County Code Chapter 2.92, Flood Control Advisory Committee RECOMMENDED MOTION (for final action): COUNCIL ACTION TAKEN: 2001 -231 7/242001: introduced 8/72001: Approved 6-0, Haag absent, Res. #2001 -046 Related File Numbers: Ordinance or Resolution Number (this item only): RFa* ti001 -p4b fczd ex- officio member resolution PROPOSED BY: CONSENT SPONSORED BY: CONSENT INTRODUCED: JULY 24. 2001 A resolution of the Whatcom County Flood Control Zone District Board of Supervisors RESOLUTION NO. 2001 -046 AMENDING WHATCOM COUNTY CODE CHAPTER 2.92, FLOOD CONTROL ADVISORY COMMITTEE WHEREAS, on January 28, 1992, the Whatcom County Council, acting as the Whatcom County Flood Control Zone District Board of Supervisors, approved Resolution 92 -015, creating the Whatcom County Flood Control Advisory Committee; and WHEREAS, Resolution 92 -015 established various guidelines for the committee, including composition and qualifcation for membership specifications; and WHEREAS, the Whatcom County Council recently discussed the membership guidelines and concluded that it would be in the public's best interest to include one of its members on the advisory board as an ex- officio member. NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Flood Control Zone District Board of Supervisors that Whatcom County Code 2.92 is hereby amended as indicated in Exhibit A to this resolution. The Whatcom County flood control zone district board of supervisors hereby creates a flood control zone district advisory committee. eempesede€ 15me ors -The advisory committee shall meet once monthly or as its members and the administrator of the county's flood control section shall determine. (Res. 92 -015 (part)). 2.92.020 Duties of the flood control zone district advisory committee. The advisory committee is charged with the following duties and responsibilities: A. To be an integral part of operations and management of the flood control zone district; to review the county comprehensive plan for flood control as it is implemented each year, and make recommendations in coordination with the administrator of the county's flood control section to the board of supervisors for its implementation; B. Discuss and recommend budget appropriations; C. Review other flood control matters as assigned by the board it supervisors; D. Act as liaison between the board of s , and the public; and, as necessary, to have hearings on behalf of the board. (Res. 92 -015 (part)). 2.92.030 Membership. The advisory committee will consist of 15 vbft members and one non - voting ex- officio member, as follows: A. Two members representing special districts such as drainage and diking, to be appointed by the board of supervisors; B. Two members representin cities impacted by flooding, to be appointed by the board of supery I which will take into consideration the recommendation of the Whatcom County Council of Governments; C. Two members representing the Indian Tribes, to be appointed by the board of supervisors, which will take into consideration the recommendations of the Nooksack and Lummi Tribal Councils; D. (Res. 92 -029 (part); Res.92 -015 (part)). E. One ex- officio member to be selected by the board of supervisors from their own members. 2.92.040 Term of office. A. The term of office for the nine members representing geographic areas within Whatcom County shall be for four years, except that three of the members appointed to the initial board shall serve for two years and three members appointed to the initial board shall serve for three years. B. The members appointed to represent special districts, the ex , fo member and the Indian Tribes shall each serve for a one -year term. These representatives may serve consecutive terms. C. No member representing a geographic area should serve more than two consecutive full terms. (Res. 94 -001; Res. 92 -029 (part); Res. 92 -015 (part)). 2.92.050 Quorum. A majority of the current active members of the advisory committee, but in no event less than seven Wrag members, shall constitute a quorum for the transaction of business. (Res. 98 -032; Res. 92 -015 (part)). 2.92.060 Staff. The staff will be pFevided by the engineeFing divisien. Public lilm Engineering will provide staff (Res. 92 -015 (part)). 2.92.070 Bylaws and election of officers. At the initial meeting, or as soon thereafter as practical, the advisory committee will meet and elect officers, adopt bylaws and such rules and regulations or procedure as are necessary for the conduct of their business; provided that such bylaws, rules, regulations or procedures must be confirmed by the flood control zone district board of supervisors. Meetings of the advisory committee shall be subject to the Open Meetings Act, RCW Chapter 42.30 et seq. (Res. 92 -015 (part)). 2.92.080 Vacancies. A. An advisory committee membership shall become vacant on the death, resignation, or recall of the member; as a result of a member's absence from two consecutive regular meetings.of the advisory committee without being excused by the committee; or for any reason a person is unable to fulfill the duties and responsibilities associated with being a committee member. B. Except for the ex- officio':_, _ber, vlacancies shall be filled by the engineering division from an alternate list of members as established by the board of supervisors. The alternate list will expire every six years. (Res.92- 029 (part)).
