SUMMARYSTATEMENT:
The County Council approved Birch Bay Water and Sewer District's
Comprehensive Sewer System Plan on January 25, 2000 under Resolution 2000-
003. Birch Bay Water and Sewer District is now seeking an amendment to
provide domestic sewer service to the ARCO (BP) Cherry Point Refinery.
(Industrial wastewater will not be treated by Birch Bay Water and Sewer District,
as ARCO will continue to treat Us own industrial wastewater).
Pursuant to RCW 57.16.010(6), the County legislative authority must approve,
conditionally approve or reject a comprehensive sewer system plan. The Planning
& Development Services Department recommends approval ofthe Birch Bay
Water and Sewer District Comprehensive Sewer System Plan, Amendment No. 1,
subject to several conditions.

RESOLUTION NO. 2001 -045 I�
CONDITIONALLY APPROVING BIRCH BAY WATER & SEWER DISTRICT
COMPREHENSIVE SEWER SYSTEM PLAN, AMENDMENT NO. 1 (ARCO)
WHEREAS, State law (RCW 57.16.010(6)) requires the County Council to
approve, conditionally approve, or reject comprehensive sewer system plans; and
WHEREAS, Birch Bay Water and Sewer District submitted Comprehensive
Sewer System Plan, Amendment No. 1 for approval on May 24, 2001. This amendment
would allow provision of domestic sewer service to the ARCO (BP) Cherry Point
Refinery; and
WHEREAS, a mitigated determination of non - significance was issued pursuant to
the State Environmental Policy Act; and
WHEREAS, Pursuant to RCW 57.16.010(6), the Birch Bay Water and Sewer
District Comprehensive Sewer System Plan, Amendment No. 1 has been approved by the
Whatcom County Division of Engineering; and
WHEREAS, Pursuant to RCW 57.16.010(6), the Birch Bay Water and Sewer
District Comprehensive Sewer System Plan, Amendment No. I has been approved by the
Whatcom County Health & Human Services Department; and
WHEREAS, the County Council reviewed the Birch Bay Water and Sewer
District Comprehensive Sewer Plan, Amendment No. I for compliance with the approval
criteria set forth in RCW 57.16.010(6)) and RCW 57.02.040 and finds that the plan
satisfies these criteria, provided that conditions of approval are met;, and
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council
hereby approves the Birch Bay Water and Sewer District Comprehensive Sewer System
Plan, Amendment No. 1 dated May 2001, subject to the following conditions:
1. Extension of the sewer line to serve the ARCO (BP) Cherry Point Refinery shall
not be used as justification for rezoning R5A property north of Grandview Rd.
2. Extension of the sewer line to serve the ARCO (BP) Cherry Point Refinery shall
not be used as justification for including the refinery in any future attempt by
Birch Bay to become a city.
