Sheri%' Sawaor Court Demurer ether Ordinance or ResoluAon Number (this item): . t " 0 3 ,/ I SPONSORED BY: Public Works 2 PROPOSED BY Public works 3 INTRODUCTION DATE: 6 / 26 /o l r 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 A Resolution by the Governing Body of the County-wide Flood Control Zone District hereinafter referred to as the Whatcont County Flood Control Zone District ( WCFCZD) RESOLUTION NO. 2001 -033 REGARDING FUNDING OF CITY OF BELLINGHAM SQUALICUM CREEK BERM PROJECT WHEREAS, reduction of flood hazards is in the best interest of the citizens of Whatcom County; and, WHEREAS, the WCFCZD previously established and is implementing a Flood Control Maintenance Program, consistent with Whatcom County Code 17.20; and, WHEREAS, the WCFCZD desires to establish and implement a Flood Hazard Reduction Program; and, WHEREAS, development of such a Flood Hazard Reduction Program is nearing completion with review and adoption intended to be completed before the end of 2001; and, WHEREAS, earlier this year the City of Bellingham delivered a flood hazard reduction project application and cost sharing request for the Squalicum Creek Bern Project; and, WHEREAS, the current draft of a proposed Flood Hazard Reduction Program, together with staff and Advisory Committee review of the subject project, indicate that the Squalicum Creek Berm Project would be an eligible project for consideration in such a new program; and, WHEREAS, the City of Bellingham has requested action be taken by the WCFCZD on this project cost sharing request as soon as possible so that they may be able to move ahead on this project without further delay. NOW, THEREFORE, BE IT RESOLVED that the WCFZCD hereby agrees to provide financial support to the City of Bellingham for the Squalicum Creek Berm Project, including design, construction, and land acquisition, not to exceed 75% of total project costs or $800,000, whichever is less, reimbursable at the time of project completion. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 BE IT FURTHER RESOLVED that WCFCZD financial support for the Squalicum Creek Berm Project is based on the expectation that the City of Bellingham will identify the lowest cost land acquisition alternative necessary for the completion of this project. BE IT FURTHER RESOLVED that the WCFCZD places the City of Bellingham on notice that once the Squalicum Creek Berm Project is complete the City of Bellingham is fully responsible to ensure future maintenance of the completed project is accomplished and the WCFCZD assumes no future maintenance responsibility for this completed project. BE IT FURTHER RESOLVED that by adoption of this resolution it is not the intent of the WCFCZD Board of Supervisors to establish any ongoing policies pertaining to a future Flood Hazard Reduction Program and action herein applies only to the Squalicum Creek Berm Project.
