(Ym N Requested Bete: 1 Resolution appointing the Clerk of the Council as Whatcom County's agent to receive tort liability claims RECOMMENDED MOTION (for final action): COUNCIL ACTION TAKEN: 2001 - 165 51152001: Approved 7-0, Res. #2001 -023 Related File Numbers: Ordinance or Resolution Number (this item only): RE5 * Z00I-023 tort claim receipt resolution 5/15/2001 PROPOSED BY: Council Clerk SPONSORED BY: Consent INTRODUCTION DATE: May 15, 2001 RESOLUTION NO. 2001 -023 APPOINTING THE CLERK OF THE COUNCIL AS WHATCOM COUNTY'S AGENT TO RECEIVE TORT LIABILITY CLAIMS WHEREAS, current statute requires that all tort liability claims be filed with the local governing body; and WHEREAS, Whatcom County claims are currently filed with the legislative branch of county government through the Clerk of the Council; and WHEREAS, with the recent passage of EHB 1530, the county is now required to formally designate an individual to receive such claims; and WHEREAS, the Whatcom County Prosecutor's Office has requested that the County Council appoint the Clerk of the Council as the county's agent to receive all tort liability claims served upon Whatcom County. NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Council that all tort liability claims filed against Whatcom County shall first be served upon the Clerk of the Council or designee.
