The reason for the name change is to eliminate some confusion and will more closely reflect the area served by the District. MOI -009 Related File Numbers: Ordinance or Resolution Number (this item only): RCS . 2CO -Ctrl 1 Water District 12 Name Change - Feb. 27, 2001 2 PROPOSED BY: Nelson 3 SPONSORED BY: Consent 4 INTRODUCED: March 6, 2001 5 6 RESOLUTION NO. 2001 -009 7 8 APPROVING A REQUEST BY WHATCOM COUNTY 9 WATER DISTRICT NO. 12 TO CHANGE ITS NAME TO 10 SAMISH WATER DISTRICT 11 12 WHEREAS, on February 8, 2001, the Whatcom County Water District 13 No. 12 Board of Commissioners approved a resolution to change its name to the 14 Samish Water District; and 15 16 WHEREAS, pursuant to RCW 57.04.065, Water District No. 12 (the District) 17 may apply to change its name by filing a certified copy of the District's approved 18 resolution with the county legislative authority; and 19 20 WHEREAS, on February 23, 2001, Terry Klimpel, District Manager for Water 21 District No. 12, filed such certified resolution with the Whatcom County Council 22 Office, thus meeting the requirements of state law. 23 24 NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council 25 hereby approves the name change from Whatcom County Water District No. 12 to 26 Samish Water District. 27 28 BE IT FURTHER RESOLVED that upon signing of this resolution, all 29 proceedings for the District shall be conducted under the new name. 30 31 BE IT FINALLY RESOLVED that all existing obligations and contracts of the 32 district entered into under its former name shall remain outstanding without change 33 and with validity unaffected by the change of the District's name. 34 35 APPROVED this 6th day of March, 2001. 36 37 WHATCOM COUNTY COUNCIL 38 TTEST: WHATCOM COUNTY WASHINGTON 39 40 41 Dana rown- Davis, a Counc L. The reason for the name change is to element some confusion and, will more closely reflect the area served by the District. The Revised Code of Washington (RCW) 57.04.065 authorizes Water Districts to change their name with the approval of the County Legislative authority. The District is requesting that Whatcom County Water District No. 12, name change be placed on the Whatcom County Council agenda for consideration. WHEREAS, Samish Water District, formerly Whatcom County Water District No. 12, serves the Lake Samish area and a large portion of the Samish basin area with sewer service; and WHEREAS, there has in the past been some confusion over the area served by this Water District; and WHEREAS, this District was originally formed as a Water District; and WHEREAS, RCW 57.04.065 authorizes Water Districts to change their names with the approval of the County Legislative authority; NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of Whatcom County Water District No. 12, Whatcom County, Washington, as follows: Section 1.: The Board of Commissioners of Whatcom County Water District No. 12 declare that the name of the District shall be Samish Water District, effective March 8, 2001, or as soon thereafter as possible, for the reason that the name Samish Water District will more closely reflect the area served by the District. Any district may apply to change its name by filing with the county legislative authority in which was filed the original petition for organization of the district, a certified copy of a resolution of its board of commissioners adopted by majority vote of all of the members of that board at a regular meeting thereof providing for such change of name. After approval of the new name by the county legislative authority, all proceedings for the district shall be had under the changed name, but all existing obligations and contracts of the district entered into under its former name shall remain outstanding without change and with the validity thereof unimpaired and unaffected by such change of name. A change of name heretofore made by any existing district„ in this state, substantially in the manner approved under this section, is ratified, confirmed, and validated.
