SUMMARYSTATEMENT.•
This ordinance authorizes Whatcom County to set parameters for the development and
operation of the Whatcom County Jail Alternatives Work Crew programs.
RCW 36.28.108 states fait "the sheriff or director ofpublic safety shall employ affable
bodied persons sentenced to imprisonment in the county Jail in such manner and at
such places within the county as may be directed by the legislative authority of the
county."
Consequently, this ordinance allows for work crews performing a variety ofjobs within
the county.

AN ORDINANCE AUTHORIZING THE SHERIFF TO
DEVELOP INMATE WORK CREWS
WHEREAS, RCW 36.28.100 authorizes county sheriffs to develop inmate work crews
from inmates sentenced to the county jail.
WHEREAS, the sheriff shall offer these crews for hire to any non -profit or governmental
entity.
WHEREAS, fees charged for work will be established by the sheriff and will be no
greater than identified cost.
WHEREAS, all fees generated under RCW 36.28.100 by work crews will be returned
to the county to offset jail costs.
WHERAS, civic
improvement
tasks performed
by offenders on work crews benefit the
community.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the
Sheriff is hereby authorized to create work crews in accordance with RCW 36.28.100.

An Ordinance Authorizing the Sheriff to Develop Inmate Work Crews

Enclosed are V, (2) originals of an Ordinance authorizing the Sheriff to develop Inmate work
Crews for your review and signature.
• Background and Purpose
RCW 136.28.100 addresses the employment of prisoners. It states that "the sheriff or director
of public safety shall employ all able bodied persons sentenced to imprisonment in the county
jail in such manner and at such places within the county as may be directed by the legislative
authority of the county."
This ordinance will provide work opportunities for those inmates able to work out of custody,
or in the case of non - incarcerated persons, the opportunity to work off fines, when resources
are not available to make proper payment. Moving low risk offenders onto alternative work
programs subsequently reduces jail population.
The Sheriff's Office would like to establish this ordinance in an effort to further develop these
crews.
Funding Amount and Source
The Funding source is the Whatcom County Jail Budget. Crew supervisors are employed by
the Jail to ran these crews, and some tools are supplied as well. However, the County also
realizes revenue, when these jobs are performed for paying agencies.
Differences from Previous Contract
There is no previous single contract for this item, as it is the first time we have written an
ordinance to cover these responsibilities.
