SUBJECT: Proposed Extension of the Duration of COUNTYEXE.0,MVE
Whatcom County Lake Management District No. 1
Background:
Whatcom County Lake Management District No. 1 was created on January 28, 1992 to construct
and operate a seasonal flow augmentation structure in Friday Creek, as a condition of DOE granting
permits for domestic water withdrawals from Lake Samish. Cleaning of the Friday Creek channel
to promote flood control was also included in the scope. Residents assessed themselves and
collected nearly $80,000 in original assessments, interest and latecomer fees, of which
approximately $28,000 remains for operation and maintenance purposes.
Originally RCW 36.61 limited the life of a Lake Management District to ten years, but it was
revised in 2000 to read "for any needed period of time." Until a permanent public water supply
system is in place around Lake Samish, DOE will continue to require operation and maintenance of
the seasonal flow augmentation structure. With LMD No. 1 currently set to expire in January of
2002, and without a permanent water supply system in place, the LMD needs to be extended.
Information:
1. Proposed Ordinance
Requested Action:
Extend the duration of Whatcom County Lake Management District No. 1 to January 28, 2012, or
until such time that a permanent water supply system is constructed and available to all properties
within said district.
