Adopted 2001-214 6/26/2001: 711012001: Atlopted ed 6 6 -0, Hoag absent, Ord. 7F2001 -033 Re[a Prosecutor Public Wads Bruce Mills Sheriff Superior Court Treasurer Other Ordinance or Reso[ (thisitem): lion /Number 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 SPONSORED BY: Consent PROPOSED BY: Public Works INTRODUCTION DATE: June 26. 2001 ORDINANCE NO. 2001 -033 AN ORDINANCE EXTENDING THE DURATION OF WHATCOM COUNTY LAKE MANAGEMENT DISTRICT NO. 19 A LAKE MANAGEMENT DISTRICT FOR LAKE SAMISH WHEREAS, Whatcom County Lake Management District No. 1 was created on January 28, 1992, by Ordinance No. 92 -006, as proposed in Resolution 91 -051; and WHEREAS, the duration of said district was extended for a cumulative period of ten years, per Ordinance No. 95 -002; and WHEREAS, RCW 36.61 was recently amended to allow lake management districts to be created for any needed period of time; and WHEREAS, the need exists to extend the duration of said district, for maintenance and operations activities, beyond the current designated expiration date; and WHERAS, no additional special assessments are proposed for said district to perform its activities; and WHEREAS, an Advisory Committee for the Lake Management District was formed per Resolution 95 -032; and WHEREAS, said Advisory Committee needs to be extended along with said district. NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the duration of Whatcom County Lake Management District No. 1, and its associated Advisory Committee, are hereby extended to January 28, 2012, or until such time that a permanent water supply system is constructed and available for all properties within said district, whichever comes first. JUN 1 2001 DATE: June 4, 2001 PETE KREMEN SUBJECT: Proposed Extension of the Duration of COUNTYEXE.0,MVE Whatcom County Lake Management District No. 1 Background: Whatcom County Lake Management District No. 1 was created on January 28, 1992 to construct and operate a seasonal flow augmentation structure in Friday Creek, as a condition of DOE granting permits for domestic water withdrawals from Lake Samish. Cleaning of the Friday Creek channel to promote flood control was also included in the scope. Residents assessed themselves and collected nearly $80,000 in original assessments, interest and latecomer fees, of which approximately $28,000 remains for operation and maintenance purposes. Originally RCW 36.61 limited the life of a Lake Management District to ten years, but it was revised in 2000 to read "for any needed period of time." Until a permanent public water supply system is in place around Lake Samish, DOE will continue to require operation and maintenance of the seasonal flow augmentation structure. With LMD No. 1 currently set to expire in January of 2002, and without a permanent water supply system in place, the LMD needs to be extended. Information: 1.
