ATTACHMENTS: • Proposed Ordinance Related County Contract # Should Clerk schedule a hearing: NO / X-1 YES / / Requested Date: SUMMARY STATEMENT: This ordinance pertains to assuring continuous Health Officer overage for Whatcom County when the local Health Officer, Dr. Greg Stern, is on vacation. The County Council confirms the appointment of the Health Officer. This ordinance would change Whatcom County Code to allow the County Executive to enter into an Interlocal Agreement with other jurisdictions to appoint an interim health officer to cover short-term absences. Delahunt, Interim Director RE: Proposed Ordinance DATE: March 29, 2001 REGINA DEIAHUNT Interim Director GREG STERN, M.D. Health Officer RECU,VEL APR 0 2 2091 PETE KREMEN COUNTY EXECUTIVE I am writing to request that an ordinance to allow for the provision of temporary Health Officer coverage for Whatcom County be submitted to County Council. Currently, there is no formal arrangement for Health Officer coverage during vacations. Many local health jurisdictions in Washington State have developed formal vacation coverage procedures for their health officers, naming specific interim health officers, which is necessary to assure a health officer with legal authority. The health officers of Snohomish Health District, Island County and Skagit County have expressed interest in entering into a reciprocal agreement with Whatcom County to provide coverage. Dr. Stern and I are working with Randy and the other local health jurisdictions on language for an Interlocal Agreement. Randy also informed me that the County Code would need to be amended. The attached ordinance will change the code to provide for this interim coverage arrangement. I request that the ordinance be forwarded to County Council at their April 17, 2001. County Council is aware that the ordinance is being forwarded because this was an agenda item at the Health Board meeting on March 27, 2001. WHEREAS, the local Health Officer is currently confirmed by the Whatcom County Council (hereinafter Council) as the primary local health officer for Whatcom County; and WHEREAS, it has come to the attention of the Council that it is in the best interest of Whatcom County to provide continuous health officer coverage in the absence of the local health officer, and WHEREAS, a temporary local health officer will provide back up coverage for the local health officer for Whatcom County; and WHEREAS, current County Code does not contain provisions allowing for temporary local health officer coverage, and WHEREAS, Whatcom County is able to enter into an Interlocal Agreement with Island, Skagit, and Snohomish Counties; and their appointed health officers, and WHEREAS, the local health officers in these counties meet the statutory qualifications set out in Chapter 70.05 RCW, NOW, THEREFORE, be it ordained by the Whatcom County Council, that a new section is added to Whatcom County Code 24.01.030 as indicated in Exhibit A to this ordinance. A. Administrative Director. In accordance with RCW 70.05.040, the county executive may appoint an administrative director separate from the health officer. The administrative director appointed by the county executive shall be subject to confirmation by a majority of the county council. The administrative director shall be appointed for an indefinite period and shall serve at the will of the county executive. B. Health Officer. In accordance with RCW 70.05.050, the county executive may appoint a local health officer who shall meet the qualifications as prescribed in RCW 70.05.050 through 70.05.055. No term of office shall be established for the health officer, but the health officer shall not be removed from office until after notice is given and an opportunity for a hearing before the county executive as to the reason for the officer's removal is provided. The health officer appointed by the county executive shall be subject to confirmation by a majority of the county council. (Ord. 95 -037). C. The executive is authorized to enter into an interlocal agreement with other counties to provide temporary coverage for the health officer when the health officer is temporarily unavailable either through a vacation or a prolonged illness without Council confirmation. If the unavailability is to last three consecutive months. Council confirmation of the appointment shall be required.
