SUMMARY STATEMENT:
This ordinance would accept a 0.4 mile portion of McLeod Road as a
county road.
RECOMMENDED ACTION:
Request that the County Council, by ordinance, accept a portion of
McLeod Road, between Bennett Drive and Hollywood Avenue, as a County
ad. See Engineer's report.

SUBJECT: Proposed Acceptance of a Portion of McLeod Road as a County Road
On February 20, 2001 the County Council declared, by resolution, the intent to accept a portion of
McLeod Road as a County Road. The resolution directed the County Road Engineer to provide a
report upon this project.
I am pleased to forward a proposed ordinance for acceptance of a portion of McLeod Road into
the County Road System as a public road, along with the Engineer's report that recommends
such acceptance.
We request that the Council hold a public hearing, and by ordinance accept and establish a
portion of McLeod Road as a County road.

SUBJECT: REPORT OF THE COUNTY ROAD ENGINEER ON MCLEOD ROAD
In accordance with RCW 36.81, we have reviewed the 0.4 mile portion of McLeod Road, from
Bennett Drive to Hollywood Avenue, for inclusion into the County road system as a public road.
Our findings are as follows:
Road Condition
This roadway was built in 1999 and constructed to county road standards under County inspection,
and was re- inspected prior to acceptance.
Right- of -Wav Status
All necessary rights-of-way have been secured from adjoining property owners for this portion of
road.
Financial Implication
It is our opinion that any additional financial burden assumed by the County for road maintenance
responsibilities for this portion of road are offset and ameliorated by increased revenues from state
tax funds for the additional length of road in the County road system.
Public Benefit
This portion of McLeod Road is a connecting route linking Hollywood Avenue to Bennett Drive
and serving several large apartment buildings, as both a primary and secondary access route. It is
our conclusion that acceptance of this portion of road as a County road provides better service to
the citizenry at a reasonable cost.
Recommendation
The Whatcom County Public Works Department accordingly recommends acceptance and
establishment of this portion of McLeod Road for inclusion into the County road system as a
public road.

IN THE MATTER OF ACCEPTING
A PORTION OF MCLEOD ROAD AS A PUBLIC ROAD
WHEREAS, on February 20, 2001, pursuant to the procedures contained in RCW
36.8 1, the County Council adopted a resolution of intent with regard to a 0.4 mile portion
of McLeod Road, between Bennett Drive and Hollywood Avenue; and
WHEREAS, pursuant to that resolution a public hearing on the issue of whether
this roadway should be established as a county road was held on March 20, 2001; and
WHEREAS, notice of the public hearing pursuant to RCW 36.81.070 was
properly given and proof of such notice was properly demonstrated pursuant to RCW
36.81.080; and
WHEREAS, in conjunction with the hearing the County Council received and reviewed
the report of the County Road Engineer on the efficacy of the establishment of this portion of
roadway as a county road; and
WHEREAS, members of the public have been provided with the opportunity to provide
the County Council with information and opinions relating to whether or not this portion of road
should become a county road; and
WHEREAS, the right of way underlying the road belongs to the County, or is deeded to
Whatcom County subject to the adoption of this ordinance; and
WHEREAS, in view of the information brought to its attention by staff and members of
the public through the hearing process, the County Council finds that establishing the road as a
county road is a public necessity and is practicable;
NOW, THEREFORE, BE IT ORDAINED that the section of McLeod Road, between
Bennett Drive and Hollywood Avenue, as described in Exhibit "A" attached hereto, within
Section 14, Township 38 North, Range 2 East of W. M., is hereby established as a county road,
effective March 20, 2001.

All that portion of County Road No. 590, a.k.a. McLeod Road, between Bennett Drive
and Hollywood Avenue, in the West half of Section 14, Township 38 North, Range 2
Fast of W.M., described as follows: -
Commencing at the Center of said Section 14 and the West line of Bennett Drive;
thence Westerly 0.4 miles, more or less, to its intersection with Hollywood
Avenue. All situated in Whatcom County, Washington.
