The resolution directed the County Road Engineer to provide a report upon this project. I am pleased to forward a proposed ordinance for acceptance of a portion of Zander Drive into the County Road System as a public road, along with the Engineer's report that recommends such acceptance. We request that the Council hold a public hearing, and by ordinance accept and establish a portion of Zander Drive as a County road. Mills, P.E. - Assistant Director 5280 Northwest Drive, Suite C Bellingham, WA 98226 MEMO TO: The Honorable Pete Kremen, County Executive, and Honorable Members of the Whatcom County Council FROM: Bruce Mills, County Road Engineer 11 � DATE: February 21, 2001 SUBJECT: REPORT OF THE COUNTY ROAD ENGINEER ON ZANDRR n1111W In accordance with RCW 36.81, we have reviewed the portion of Zander Drive, from V2 mile south of East Smith Road for approximately an additional 0.6 miles, for inclusion into the County road system as a public road. Our findings are as follows: Road Condition This roadway was initially constructed to county road standards under County inspection, and was re- inspected prior to acceptance. The applicants have performed the County requested corrections to said roadway to fully conform to county standards. Right -of -Way Status All necessary deeds from adjoining property owners were prepared by our office and have been signed, and will be accepted by the County, subject to favorable consideration by the County Council of acceptance of said road. Financial Implication It is our opinion that any additional financial burden assumed by the County for road maintenance responsibilities for this portion of road are offset and ameliorated by increased revenues from state tax funds for the additional length of road in the County road system. Public Benefit Although this portion of Zander Drive is presently a dead end road, it serves about 16 properties, generating about 160 vehicle trips per day. Converting this portion of road to a county road will allow the Meridian School District buses to better serve the adjoining property owners. It is our Conclusion that acceptance of this portion of road as a County road provides better service to the citizenry at a reasonable cost. Recommendation The Whatcom County Public Works Department accordingly recommends acceptance and establishment of this portion of Zander Drive for inclusion into the County road system as a public road. bgm\ Phone: 13601 6]6 -6]30 County: (360) 380 -8110 FAX: (360) 676 -6558 SPONSORED BY: eneinerine PROPOSED BY: Engineering INTRODUCTION DATE: 3/6/01 6 ORDINANCE NO. 2001 -007 7 8 IN THE MATTER OF ACCEPTING 9 A PORTION OF Z,ANDER DRIVE AS A PUBLIC ROAD 10 11 WHEREAS, on February 20, 2001, pursuant to the procedures contained in RCW 12 36.8 1, the County Council adopted a resolution of intent with regard to a portion of 13 Zander Drive, from %: mile south of East Smith Road for approximately an additional 0.6 14 miles; and 15 16 WHEREAS, pursuant to that resolution a public hearing on the issue of whether 17 this roadway should be established as a county road was held on March 20, 2001; and 18 19 WHEREAS, notice of the public hearing pursuant to RCW 36.81.070 was 20 properly given and proof of such notice was properly demonstrated pursuant to RCW 21 36.81.080; and 22 23 WHEREAS, in conjunction with the hearing the County Council received and reviewed 24 the report of the County Road Engineer on the efficacy of the establishment of this portion of 25 roadway as a county road; and 26 27 WHEREAS, members of the public have been provided with the opportunity to provide 28 the County Council with information and opinions relating to whether or not this portion of road 29 should become a county road; and 30 31 WHEREAS, the right of way underlying the road belongs to the County, or is deeded to 32 Whatcom County subject to the adoption of this ordinance; and 33 34 WHEREAS, in view of the information brought to its attention by staff and members of 35 the public through the hearing process, the County Council finds that establishing the road as a 36 county road is a public necessity and is practicable; 37 38 NOW, THEREFORE, BE IT ORDAINED that the section of Zander Drive, from %a mile 39 south of East Smith Road for approximately an additional 0.6 miles, as described in Exhibit "A" 40 attached hereto, within Sections 33 and 34, Township 39 North, Range 3 East of W.
