ADOPT- ING THE UNIFORM BUILDING CODE, THE FIRST NAMED CODE SHALL GOVERN OVER THE FOLLOWING; AND ALL ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED. WHEREAS, Chapter 96, Laws of the State of 1ashington, 1974 Extra Session (Revised Code of Washington, Chapter 19.27), placed into effect on or after January 1, 1975 in all cities, towns, and counties a State Building Code; WHEREAS, R.C.I..I. 19.27.020 through 19.27.030 provides that counties are authorized to amend the State Building Code as it. applies within its juris- diction in all such respects as shall not be less-than minimum performance standards and objectives including the authority to adopt any subsequent re- visions to the codes; WHEREAS, the 1979 publication of the Uniform Mechanical Code, 1.979 Edition, the Uniform Fire Code, 1979 Edition, and the Uniform Plumbing Code, 1979 Edition, exceeds the minimum performance standards and objectives of R.C.1-4. 19.27; NOW, THEREFORE, THE 1,1HATCOM COUNTY COUNCIL DOES ORDAIN: Section 1. PURPOSE. To promote the health, safety and welfare of the occupants or users Ordinance - 1. Section 2. The 1979 Edition of the Uniform Mechanical Code, including Chapter 22, Fuel Gas Piping, and Appendicies.A, B and C, and supplements thereto, published by the International Conference of Building Officials and the International i Association of Plumbing Officials, including each and all of the rules and regu- lations printed therein, is hereby adopted by reference and shall be in full force and effect in What.c.om County upon adoption of this ordinance, except as herein modified. Section 3. Subsection 201(x) of the Uniform Mechanical Code, 1979 Edition, is hereby amended to read as follows: The Building Administrator is hereby authorized and directed to en- force all provisions of this code. For such purpose he. shall have the powers of a police officer. Whenever the term "Building Official" is used in this code, it shall be construed to mean the Building Administrator and Chief Code Enforce- ment Officer of Whatcom County. Whenever the term "authorized representative" is used in this code, it shall be construed to mean the Public Service Inspector. Whenever the term "Board of Appeals" is used in this code, it shall be construed to mean the County Board of Appeals. Section 4. Section 203 of the 1_979 Edition of the Uniform Mechanical Code is hereby amended to read as follows: Section 203. Board of Appeals. Additional plan review required by changes, additions or revisions to approved plans .............. $15.00 per hour (minimum charge - one -half hour) Section 6. Section 506 of the Uniform Mechanical. Code, 1979 Edition, is hereby supplemented and amended to :include the following subsection: Subsection 506(a). Stable Pilots. All new or used gas-burning ap- pliances whose rate Btu input is 400,000 BtuS per hour or more shall. be equipped with a stable pilot or pilots capable of providing safe ignition. The flame will be supervised by a flame safeguard which supervises the pilot at the point of ignition of the main burner, and it shall have response timing, de- energyz- ing the gas shut -off device in not to exceed 5 seconds in case of flame failure. Provided, however, in the case of listed equipment the safety pilot system and gas control system used on such equipment will be accepted. Subsection 704(8) of the Uniform Mechanical. Code, 1979 Edition, is hereby amended to read as follows: Subsection 704(8). In any room used or designated to be used as a bedroom, bathroom, closet or in any confined space with access only to such room or space. The access to any furnace located in an attic or under -floor crawl space may be through a closet. Exception: gas and heating appliances, other than electrical heating appliances or fireplaces with adequate combustion, shall not be installed in bedrooms, bathrooms, closets or confined spaces or areas. Fuel.- burning heating equipment with sealed combustion systems or enclosed fur - naves with a separate supply of combustion air will. be allowed. Section 8. Subsection 2203(a) of the Uniform Mechanical Code, 1979 Edition, is hereby amended to read as follows: Subsection 2203(a). A meter location shall. be provided by the con- sumer for the building or premises to be served. Said meter location to be at the exterior of the building on all buildings constructed after the effective date of this ordinance and wherever possible in all existing buildings. Where a gas meter must be located inside a building, it shall. be enclosed in a room or vault separate from any source of ignition and this room or vault shall. be vented to the outside area and subject to the approval of the inspector before installation. No gas meter shall be hereafter installed under a stoop, stairway, show window, or porch or in an. un- ventilated or confined space. Section 9. The Uniform Fire Code, with appendic.ies thereto and latest supplement. 1979 Edition, published by the International Conference of Buildings Officials and the Western Fire Chiefs Association, is Hereby adopted by reference includ- ing each and all the rules and regulations printed therein and shall be in full force and effect in Whatcom County upon adoption of this ordinance except as herein modified. Section 10. Section 2.302 of the Uniform Fire Code, 1979 Edition, is hereby amended to read as follows: Section 2.302. In order to determine the suitability of alternate materials and types of construction, and to provide for reasonable interpre- tation of the provisions of this code, the County Board of Appeals shall be empowered to pass upon the pertinent materials herein. The Fire Marshal of Whatcom County shall. be an ex-officio member of the County Board of Appeals on all materials pertaining to the Uniform Fire Code for the purpose of recom- mending regulations consistent with nationally recognized good practices for safeguarding, to a reasonable degree, life and property from the hazards of fire and explosives and the use of systems, materials, and devices; hazards to life or property in the use or occupancy of buildings or premises. Section 9.125 of the Uniform .Fire Code, 1979 Edition is hereby amended by adding thereto a new section entitled "Definit:ions" to read as follows: Ordinance - 7. 1 Section 9.108. Definitions. When any portion of the building or structure protected is in excess of 150 feet from a water supply on a public street, there shall. be provided, when required by the Fire Marshal or Building.Offi.cial., on -site fire hydrants and mains capable of supplying the required fire flow. Water supply and fire flow shall be determined by the Whatcom County Fire Marshal and the Whatcom County Building Official and approved by the Director of Public Works. Water supply may consist of reservoirs, pressure tanks, elevator tanks, water mains, or other fixed system capable of supplying the required fire flow. In setting the requirements for the fire flow, the Fire Marshal and /or the Building Official may be guided by the standard publication by the Insurance Service Office, "Guide for Determination of Required Fire Flow." The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the public street or on the site of the premises to be. protected as required and ap- proved by the Fire Marshal and /or the Building Official. All hydrants shall be accessible to the Fire Department or District. Apparatus by roadways shall meet the requirements of Section 10.208 and the approval of the Director of Public Works. The 1979 Edition of the Uniform Plumbing Code, with later supplements and appendicitis thereto, is hereby adopted by reference including each and all rules and regulations and appendicies therein shall. be in full. force and effect in Whatcom County upon adoption of this ordinance, except as herein modified, provided that Chapter 11 of this code is not adopted; provided that notwith- standing any wording in this code, nothing in this code shall apply to installa- tion of any gas piping, water heaters, or vents for water. heaters. Section 17. Part 1, Section 20.1 of the Uniform Plumbing Code, 1979 Edition, is 1 hereby amended to read as follows: Part 1 "Administration," Section 20.1 "Administrative Authority" is hereby amended to read as follows: Whenever the term "Administrative Authority' I Ordinance - 9. u I 1 or "Plumbing Official" is used in this code, it shall be construed to mean the 2 Building Administrator and /or his authorized representative. 3 Section 18. 4 Section 20.3 of the 1979 Edition of the Uniform Plumbing Code is 5 hereby amended to read as follows: 6 Section 20.3. Upon Issuance of Permit. The issuance or granting of 7 a permit or approval of plans shall not prevent the Building Official from 8 thereafter requiring the correction of errors in said plans and specifications 9 or from preventing construction operations being carried on thereunder under any 10 violations of this or any other ordinance or code or from revoking any certifi- 11 cate or approval when issued in error. Every permit issued under the provisions 12 of this code shall expire by limitation and become null and void if the work 13 authorized by such permit has not commenced within 120 days from the date of 14 issuance or if the work authorized by such permit is suspended or abandoned, at 15 any time after the work has commenced, for a period of 120 day::. Before such 16 work can be recommenced, a new permit shall be first obtained, and the fee shall 17 be one -half of the amount required for a new permit for such work, providing no 18 changes have been made, or will be made in the original plans and specifications 19 for such work and provided further that such suspension or abandonment has not 20 exceeded one year. 21 Section 19. 22 Section 20.7 of the 1979 Edition of the Uniform Plumbing Code is 23 hereby amended to read as follows: 24 Section 20.7. Chapter 1. of the Uniform Plumbing Code, 1979 Edition is hereby amended _ y adding thereto the following definitions, to read as follows: I Subsection 20.111. Definition of Journeyman Plumber means any person wh as been issued a certificate of competency by the Department of Labor and Industr a's provided in R.C.W. Chapter 18.106. Subsection 20.104.Definition of Contractor,as used in this ordinance,is (Ordinance - 11. 0 1eS 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 any person, firm or corporation who or which, in the pursuit of independent business, undertakes to or offers to undertake or submits a bid to construct, alter, repair, add to, subtract from, improve, move, erect or demolish for another any building, highway, road, railroad, excavation, or other structure, project, development or improvement attached to real estate or to do any part thereof illCluding the installation of .carpeting or other floor covering, plumb- ing, sewer, potable water, processed water, or other work in connection there- with, or who installs or repairs roofing or siding„ who does similar work upon his own property, employs members of more than one trade, a single job or pro- ject, except otherwise provided and as defined in Chapter R.C.W. 1.8.27. Section 21. The Uniform Plumbing Code, 1979 Edition, is hereby amended by adding thereto a new section to read as follows: Subsection 20.15. No person shall engage in the trade of plumbing as a Journeyman or as a specialist plumber without having a current certificate of competency as required by Chapter R.C.W. 18.106. It shall be unlawful for any person or persons, firm, partnership or corporation to submit any bid or do any work as a contractor unless such person or persons or corporation shall have been issued a certificate as required in R.C.il. Chapter 18.27. The Uniform Plumbing Code, 1979 Edition, is hereby amended by adding thereto a new section to read as follows: Section 20.16. The public sewer may be considered as not being avail.- able when such public or any building or any exterior drainage facility connecte thereto is located more than 150 feet from any proposed building or exterior drain- age facility on any lot or premises which abuts and is served by such public sewer. It shall be the duty of the District Health Officer to enforce connec- tions to available public sewer. In no event shall a building sewer be less than 4 inches in diameter. Building sewer or drainage pipe shall not be run or laid i the same trench with waater service pipes or any underground water pipes unless both of the following requirements are met: The bottom of the water pipe at all. The water pipe shall be placed on a solid shelf excavated on one side of the common trench. , Section 23. Table A, Nonmetalic Piping, at page 23 of the 1979 Edition of the Uniform Plumbing Code is hereby amended to include the following: Bi.tuminized fiber sewer pipe and fittings shall not be allowed. Section 24.. Subsection 401(x) of the 1979 Edition of the Uniform Plumbing Code is hereby amended to-read as follows: Subsection 401(a). Materials. Drainage pipe shall be of cast iron, galvanized wrought iron, lead, copper, brass, ABS, PBC, or other approved materials having a smooth and uniform bore, EXCEPT: that no galvanized wrought iron or galvanized steel pipe shall be used underground and shall be kept at least 6 inches above ground. ABS or PBC installations limited to residential I construction for waste and vents to 30 feet in height. Plastic waste and vents may be allowed in all residential buildings or structures in which the lowest floor elevation and the top floor finished ceiling do not exceed 30 feet. Section 25. Subsection 1005(f) of the 1979 Edition of the Uniform Plumbing Code is hereby amended by adding thereto a new section to read as follows: Subsection 1005(f). A single control valve shall be installed on a water supply line ahead of any automatic metering valve which supplies a battery of fixtures. The Administrative Authority may allow a ground key stop and waste in instances where a gate valve will not properly serve. Subsection 1008(f) of the 1.979 Edition of the Uniform Plumbing Code is hereby amended by adding thereto a new section to read as follows: Subsection 1008(.f). Water service pipes or any other underground wate . pipes shall not be run or laid in the same trench with any electrical service wire unless one of the following conditions is met: 1. A minimum horizontal separation of two feet is maintained at all points along the line, or Ordinance - 13. [Where water service pipes cross electrical service wires, a minimum vertical separation of one foot shall be maintained. Section 27. PERMIT FEES Permit fees shall be as stipulated in each respective code as adopted by this ordinance unless otherwise modified by this ordinance. Any modification of fees shall be made by the Building Official with prior written approval of the County Executive with County Council confirmation. Section 28. APPEAL. Written notice of appeal and fee of $25.00 to be tendered to the Building Official who shall transfer said notice and any files and records per- taining to the appeal to the Chairman of the Board of Appeals within 16 days after notice of an appeal is received. The Chairman shall schedule the meeting of the Board and notify the members thereof and all other interested parties. lAt the meeting the Board shall review the case and render its written decision. Section 29. PENALTIES. Violations of any provision of this ordinance shall be deemed a misdemeanor and each day during which such violation is continued or committed shall constitute a separate offense and upon conviction of a violation shall be punishable by fine not to exceed $500.00 or by imprisonment in the County jail for not more than 90 days or both such fine and imprisonment. Section 30. SEVERABILITY. If any section, subsection, sentence, clause, phrase or portion of this code or ordinance adopted herein is for any reason held to be invalid or cuiconstitutional by the decision of ,a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or the codes herein.
