ORDINANCE NO. 79 -73
AN ORDINANCE REGARDING THE REGULATION OF
THE SIU-.E OF KEGS OR OTHER CONTAINERS OF
SEVEN (7) GALLONS OR JMORE OF MALT LIQUOR
WHEREAS, it is in the interest of Whatcom County to
impose a r �gi st-ration requirement on sellers and buyers of con-
tainers containing soven ( 7 ) gallons or more of malt liquor to
assist the Wbatcom Co!anty Sheriff's Department in the enforcement
of statF� and local liquor laws.
NOW, THEREFORE, BE IT ORDIAANCD BY THE WHATCOM COUNTY
1 COUNCIL:
Section 1. Sale of Malt Liquor - Any person who
sells or offers for sale kegs or other containers containing
severr (7) gallons or more of malt liquor to consumers who are not
licensed under R.C.W. 66.24 shall:
a. Require the puchaser to sign a receipt for the
bEsvera.ge and provide the following:
1. Two pieces of identification, one of which is
a motor vehicle operator's license or a Washington State Identi-
f :i c: wis i o n Card;
2. A sworn statement providing that the purchaser
not allow any person under the age of twenty -one to consume
the beverage except as provided in R,C.W. 66.44.270, and that the
purchaser will. not remove or obliterate the numbered label affixed
to the container
b. Record the identification of the keg or container
for the purpose of tracing the items if the contents are consumed
in violation of this code in the following manner:

container on the receipt;
2. Identify the keg or container purchased by affixing
a numbered lat)el to the keg or container;
Rti cord on the receipt the identification number from
the numbered label. The original copy of the receipt shall be
mailed to the Sheriff's Office by the seller within one week of the
purchase and shall be reta.iried by the Sheriff's Office for a
period of olne (1) year. A copy of this receipt shall be provided
by the seller to the purchaser at the time of purchase. A third
cop; may be retained by the seller at his option.
Se ction 2. Penalties - Violation of any provision of
this section is a misdemeanor and punishable by a fine of $500.00
and /or six (6) months in the county jail.
Section 3. Effective Date - This ordinance shall become
effective March 1, 1980.
