ORDINANCE NO. 79 -64
AN ORDINANCE AMENDING CHAPTER 8
OF THE WHATCOM COUN ")Y CODE EN-
TITLED " WHATCOM COUNTY SUBDIVISION
REGULATIONS," ADOPTED DECEMBER 9,
1971 AND AMENDMENTS THERETO.
THE WHATCOM COUNTY COUNCIL DOES ORDAIN:
Section 1.
Section 8.20.030 of, the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.20.030. PRELIMINARY FEES. Applications shall be accom-
panied by the following fees, payable in cash or by separate checks to the
Bureau of Buildings and Code Administration.
1. $200.00 plus $5.00 per lot to the Whatcom County Current Ex-
pense Fund to cover Planning Department and other administrative .costs; and
2. $50.00 plus $5.00 per lot to the Whatcom County Road Fund to
cover Engineering Department costs; and
3. $30.00 plus $1.00 per lot to the local Health Department Pool-
ing Fund to cover Health Department costs.
4. When any given project requires more than one of the following
permits or applications, the total amount of fees shall be reduced by 25 percent
of the required aggregate permit and application fees; provided any fees re-
ceived for processing of an EIS shall not be included as part of the total
amount of fees to be reduced by 25 percent.
A. Subdivision plat application;
B. Rezone application;
C. Substantial Development Permit;
D. Major Development Permit.
.5. In the atvent that actions of an applicant result in the.repe-
titi.on of the reviews, inspections, and other steps in the approval process,
those items or steps repeated shall be charged to and paid by the applicant
prior to any further processing of the application by the County. The costs

shall be determined by the Director of Planning based upon the following rates:
A. . Planning Department staff $20.00 /Hr.
B. Engineering Department staff $20.00 /Hr.
C. Health Department staff $20.00 /Hr.
D. Legal Notice $20.00 plus actual publica-
tion cost of notice.
Section 2.
Section 8.20.060 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.20.060. EXTRAORDINARY INSPECTIONS. Additional inspections
not required in the normal processing of subdivision approval may be arranged
at the discretion of the Director of Public Works, the County Planner or the
District Health Officer, subject to advance payment of a fee estimated to cover
the full cost of providing such inspection. Full cost shall mean inspector's or
inspectors' or engineer's salary and benefits and transportation costs.
Section 3.
Section 8.20.130 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.20.130. FINAL PROCEDURE.
1. The final plat and supporting data shall be prepared in accor-
dance with Section 8.40.020 and shall be submitted to the County Planner to-
gether with the following fees, payable in cash or by separate checks to the
Bureau of Buildings and Code Administration.
A. $200.00 per subdivision plus $10.00 per lot to the County
Road Fund for field and office engineering and inspection
of the plat, roads, utilities, drainage and other improve-

B. $2.00 per lot payable to the local Health Department Pool -
in& Fund..to cover final Health Department inspections and
approvals.

C. $200.00 per subdivision to cover Planning Department and
other administrative expenses, not including fee for filing
by County Auditor.
2. The County Planner shall cause the final plat to be circulated
to the Bureau of Engineering and Health Department for approval in accordance
with the conditions of the preliminary approvals, and the requirements of this
and other applicable laws and ordinances. A copy of the plat shall also be pro-
vided to the County Assessor who shall segregate the assessed valuation of the
property being platted and furnish same to the County Treasurer for segregation
of taxes.
Section 3.
Section 8.20.140 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.20.140. RENE14AL AND EXTENSION PROCEDURE. Plats for which
preliminary approval has become invalid or has expired or for which an extension
is requested prior to expiration may be submitted for reconsideration in the
same manner as a new application together with the following fees payable in
cash or by separate checks to the Bureau of Buildings and Code Administration.
1. RENEWAL.
A. $200.00 plus $5.00 per 'lot to the Whatcom County Current
Expense Fund to cover Planning Department and other admin-

isttative costs.
B.. $25.00 plus $1.00 per lot for administrative and engineer-
ing services of the Bureau of Engineering.
C. $15.00 to Health Department Pooling Fund to cover Health
Department costs.
Such plats' submitted shall conform with regulations and standard
in effect at the time of reapplication.
2, EXTENSIOATS .
A. $100.00 plus $2.00 per lot to Whatcom County Current Expens
Fund to cover Planning Department and other administrative

Section 4.
Section 8.20.160 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.20.160. PLAT VACATION REPORT FEE. Each application to the
Whatcom County Council for vacation of any plat or portions thereof shall be ac-
companied by a fee of $75.00 to cover Planning Commission and departmental ad-
ministrative costs for the preparation of reports to the Whatcom County Council
on proposed plat vacation.
Section S.
Section 8.28.020 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.28.020. APPLICATIONS. Applications for approval of short
subdivisions shall be prepared in accordance with Section 8.40.030 and shall be
submitted to the Technical Committee through the Planning office together with
the following fees. All fees payable to the Bureau of Buildings and Code Ad-
ministration except as provided herein.
1. $100.00 plus $5.00 per lot per short subdivision to the Whatcom
County Current Expense Fund;
2. $100.00 plus $25.00 per lot per short subdivision for adminis-
trative and engineering servides of the Bureau of Engineering;
3. Health Department fees, in accordance with the fee schedule
adopted by the Health Board, shall be payable directly to the Health Department.
4. No fees shall be charged for a single division of a tract of
land provided:
Ordinance - 4.
A. TheR division satisfies the requirements of the local Health
Department and is so certified;
B. The division is described by a licensed land surveyor and
is so certified; and

C. The division is not a continuity of a previous development
. of one or more lots or parcels.
5. No fee shall be charged for consideration of a single division
to be mad-c- by deed release from a tract of land being purchased on a real estate
contract, provided that such division is intended for financial purposes or
other use by the contract purchaser and not for sale or lease.
Section 6.
Section 8.28.040 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.28.040. APPEAL. Any person or persons or public agency
agrieved by a decision to approve or disapprove a short subdivision or short
subdivision variance must, prior to any court review, have the decision reviewed
by the Hearing Examiner. Application for such review shall be made to the
Bureau of Buildings and Code Administration within 30 days following issuance
of the decision, together with a written statement of the grievance and a fee
of $75.00 payable to the Bureau of Buildings and Code Administration. The Hear-
ing Examiner shall make a final decision within 10 working days following the
conclusion of all testimony and hearings.
Section 7.
Section 8.44.015 of the Whatcom County Subdivision Regulations is
hereby amended to read as follows:
Section 8.44.015. FEES. Application for subdivision plat variance
shall be accompanied by a fee of $75.00 payable to the Bureau of Buildings and
Code Administration.
