ORDINANCE NO. 79 -27
AN ORDINANCE AMENDING THE 1976 EDITION OF
THE UNIFORM BUILDING CODE BY ADDING AND
AMENDING THERETO SECTION 302(a) WHATCOM
COUNTY CODE 2.05A.090
THE WHATCOM COUNTY COUNCIL DOES HEREBY ORDAIN THAT SECTION
302(a) OF THE UNIFORM BUILDING BODE, 1976 EDITION; IS HEREBY
AMENDED TO READ AS FOLLOWS:
Section 9. (W.C.C. 2.05A.090) Section 302 (a) Building Permit;
(Issuance) The application, plans and specifications filed by any
applicant for a permit shall be checked by the Building Official.
Such plans may be reviewed by other departments of the County to
check compliance with the laws and ordinances under their jurisdic-
tion (such as Subdivision Regulations, Health Department Regulation:
Zoning Regulations). If the Building Official is satisfied with the
work described in the application for a permit and the plans filed
therewith conform to the requirements of this code and other
pertinent laws and ordinances, and the fees specified in Section
303(a) have been paid, he shall issue a permit therefor to the
applicant provided that the plans indicate that the proposed
structure is to be contructed upon a legal lot of record.
2411 A lot is a fractional part of subdivided lands having fixed
25 boundaries being of sufficient area and dimension to meet minimum
26 zoning requirements for width and area. The terms shall include
27 tracts or parcels. Such a lot or parcel of land shall abut or have
28 access to a county maintained road.
29 A legal lot of record:
30 A lot as shown on an officially recorded plat, short subdivi-
31 sion or a parcel of land officially recorded as a unit of property
32 land is described by metes and .bounds or a combination of adjacent

and contiguous lots of record or a part of a lot of record,
provide
however, if the lot or parcel of land does not abut upon a
county
maintained road, the Building Official may issue a building
permit
provided the applicant has or can obtain legal access or in
the
instance tDe lot abuts a platted but unimproved county right -of -way
a building permit may be issued if the applicant can obtain
a trail
permit from the County Engineer and will comply with terms
of the
Trail Permit.
