ORDINANCE NO. 79 -26
AN ORDINANCE DELEGATING TO THE COUNTY
EXECUTIVE THE AUTHORITY TO APPROVE REIMBURSABLE
WORK BY WHATCOM COUNTY ENGINEERING DEPARTMENT
FOR DEPARTMENTS OF THE COUNTY AND OTHER PUBLIC
AGENCIES
WHEREAS, Washington Administrative Code Section
136- 1.0- 050(4)(c) requires a written policy
statement to supplement chapter 136 -32 WAC,
indicating any delegation of authority in
processing requests for approval of work to be
performed by the county road department for
other public agencies;
AND WHEREAS, WAC 136 -32 -030 requires that work
performed by the county road department for
other departments of the county be done in
accordance with the policy adopted pursuant
to WAC 136 -10- 050(4);
AND WHEREAS, WAC 136 -18 -030 as amended in 1978
requires unanimous approval by resolution of the
county legislative authority to amend an adopted
county road program;
NOW, THEREFORE, BE IT ORDAINED BY THE WHATCOM
1 COUNTY COUNCIL:
Section 1. Amendments to the county road program
shall be made only upon approval of the Whatcom County Council.
Section 2. Authority is hereby delegated to the
Whatcom County Executive to approve and process requests for
work to be performed for
(a) other departments of the county; and /or
(b) other public agencies
where the county road department is to be reimbursed the cost
of such work performed plus ten percent, in "accordance with a
signed CRAB type form of agreement.
Section 3. Authority is also delegated to the
Whatcom County Executive to authorize, and approve work to be

performed by or on behalf of the county road department when
such work was contained in and is by way of implementation of
a council approved county road program currently in effect.
