ORDINANCE NO.79 -19
AN ORDINANCE in the matter of amending
the zoning text and map of the WThatcom
County Zoning Ordinance to reflect rural
residential - Island and Forestry :Zoning
for Lummi Island.
WHEREAS, on April 16, 1.979, the Board of County Commis-
sioners adopted the Lummi Island Comprehensive Plan, intended to
guide in the future physical development and conservation of
Lummi Island; and
. WHEREAS, the Lummi Island Comprehensive Plan recommends
that the goals, policies and land use proposals contained within
said document be implemented by appropriate amendments to the
Wh.atcom County Zoning Ordinance specifically the creation of a
new Zoning District denoted as rural residential - island and the
designation of the southern half of Lummi Island as forestry; and
WHEREAS, the Planning Staff has prepared and presented
such amendments at public hearings pursuant to R.C.W. 36.70.590
and conducted by the Planning Commission on.April 10th and 'May oth
1979; and
WHEREAS, the majority of testimony received at said
hearings supported amendments to the Whatcom County Zoning
Ordinance; and

WHEREAS, the Planning Department adopted a final
declaration of nonsignificance pursuant to R.C.W. 43.21C based
upon an Environmental check list; and
WHEREAS, on May 8, 1979, the Planning Commission
recommended adoption of the amendments to the Zoning Ordinance;
and
WHEREAS, the amendments will implement the Lummi
Island Comprehensive Plan and be consistent with the plans and
policies. The result will be that the amendment will serve as
the official control that regulates land use actions on the
island.
NOW, THEREFORE BE IT ORDAINED AND ESTABLISHED:
That the Whatcom County Zoning Ordinance is amended to
include a new section entitled 2.24.261 RR-1 Rural Residential -
Island and further amendments to the Forestry Zone section 2.24.
280, attached and incorporated by reference hereto as Exhibits
"D" and "E ".
BE IT FURTHER ORDAINED AND ESTABLISHED:
-hat the Interim Zoning Map area numbers 68, 79 and
a portion of 80 be amended from Genera]_ Protection to Rural
Residential - Islan.d and maps number 90, 91 and a portion of 80
be amended from General Protection to Forestry, as signified by
Exhibit "H" which is attached and incorporated by reference
! hereto .

.010 'The purpose of this district is to allow for a harmonious
mixture of residential, retail commerc:;Lal, public uses an(l
those light industrial uses associated with agriculture,
forestry and fishing. In addition the district requires that
new light industrial, retail commercial and residential uses
complement the rural character by adherence to the goals and
policies of the Lummi Island Plan.
Furthermore, where pertinent sections of the plan encourage
the use of density transfer as a means of conserving land,
this zoning district provides for the creation of more
spatially efficient building lot sizes, provided the overall
density as designated within the plan is adh red to.

.051 Single Family Residential

.054 Home Occupations
.100 Conditional Uses: The following conditional uses may be
permitted within the RR -I zone district upon determination
by the Whatcom County Hearing Examiner that said uses will
be consistent with the goals and policies of the Lummi
Island Comprehensive Plan and the conditional use development
criteria of section 2.24.660 (.610 - .618) of the Whatcom
County Zoning Ordinance.
.1.01 Light Industrial uses associated with fishing,
forestry and agriculture, including manufacturing,
processing, repair and storage and distribution
of goods.
.102 Multiple family dwellings not to exceed four
living units per structure.
.103 Commercial uses including retail trade, professional
and personal services.
.104 Public Uses.
150 Prohibited Uses: All uses not permitted by right or
condition are prohibited.
200 Minimum Lot Area: Each building lot shall not be less
than 3 acres in size unless otherwise provided in the
Lummi Island Comprehensive Plan policies or unless a
density transfer option has been utilized.
300 Density Transfer Option: The following; provisions shall
apply to the utilization of the density transfer option
as a means of creating more spatially efficient building
lots, parcels and tracts-.
.301 Gross density shall not exceed one unit per
three acres.
.302 Minimum lot sizes shall be governed by the
districts set back provisions and approval by

.500 Height Limitations:
Building heights shall not exceed 24 ft, and shall
be measured from the average finish grade elevation
of the structure.
.600 Parking Requirements:
As required in Section 2.24,620.

Density transfers,shall only apply to the
original area and dimensions of recorded
parcels existing at the tinje of adoption of
this section.

The Whatcom County Prosecutor's office shall
attach a deed restriction to the original
parcel of record indicating the total number
of developable building sites (if any) resulting
from full or partial use of the assigned density.

Deed restrictions shall be binding on the property
until such time that the Lummi Island Comprehensive
Plan and RR -I zone district are amended to allow
otherwise.

All lots, parcels, and /or tracts shall be; created
for building purposes and shall be held _;.n ci.ther
single or common ownership.

Front Yard Required:
25 ft. from the edge of right -of -way.

Side Yard Required:
Not less than. 5 ft., except that on a corner
lot the side yard on the street side shall
not-be less than 25 feet from the edge of the
road right -of -way.

Not less than 5 ft.

Zoning Ordinance text:
FORESTRY . SECTION 280
.350 Setbacks
.351 Front Yards:
(Strike "no residential. structures and
assessory buildings" in the first
sentence)
Add the following sentence:
"Residential structures and assessory
buildings shall not be located less
than 25 ft. from the edge of road
right -of- way ".
.352 Side and Rear Yard:
Forest industry buildings, stationary
equipment or storage areas shall be
located a minimum of 50 ft. from any
property line. "Residential and
assessory buildings shall not be located
less than 5 ft. from any property line ".
