ORDINANCE N0. 80 -87
AN ORDINANCE AMENDING ORDINANCE NO. 80 -60
PROVIDING FOR THE CREATION AND MAINTENANCE
OF A ROAD IMPROVEMENT GUARANTY FUND, AUTHOR-
IZING TAX LEVIES TO MAINTAIN SUCH FUND, AND
PROVIDING FOR PAYMENT INTO AND DRAWING OF
WARRANTS AGAINST SUCH FUND, TO CONFORM WITH
R.C.W. 36.88.220 AND TO DELETE REFERENCE TO
THE TAX LEVY.
WHEREAS,the County Council of Whatcom County, Washington, has found
and declared that the welfare and best interests of the inhabitants of Whatcom
County and public necessity and convenience require that road improvement
districts be established from time to time in Whatcom County; and
WHEREAS, Chapter 36.88 Revised Code of Washington authorizes the is-
suance of bonds and warrants.for the payment of all or part of the cost of
improvements in such districts, and also authorizes the establishment of a
guaranty fund to guarantee to the extent of such fund payment of road improve-
ment district bonds and warrants of the County; and
WHEREAS, the County Council in a regular session on the 21st day of
August, 1980, approved Ordinance 80 -60, an ordinance of the County providing
for the creation and maintenance of a road improvement guaranty fund, and
authorizing tax levies to maintain such fund and provide for payment into and
drawing of warrants against such fund; and
WHEREAS, subsequently it has been determined that any reference to
tax levy should be deleted from said ordinance to avoid the necessity for said
tax levy against the guaranty fund,
NOW, THEREFORE, THE WHATCOM COUNTY COUNCIL DOES ORDAIN that Ordinance
No. 80 -60, Section 2, is hereby amended to read as follows.
Section 2: In order to maintain said Fund, there shall be deposited
annually in the Guaranty Fund, from monies available for road purposes, such
sums as
may be
necessary to
establish and maintain a balance therein
equal to
at least
five
percent (5%)
of the outstanding obligations which are
guaranteed
by this fund; and provision shall be made in the Whatcom County annual budget
therefor.
