ORDINANCE NO. 80 -51
AN ORDINANCE AMENDING A FRANCHISE DATED THE 22ND DAY
OF DECEMBER, 1967, ENTITLED "IN THE MATTER OF A FRANCHISE
TO INSTALL, OPERATE AND MAINTAIN AUDIO- VISUAL CABLE DIS-
TRIBUTION LINES ALONG CERTAIN ROADS IN WHATCOM COUNTY,
WASHINGTON"
Preamble: WHEREAS, Nation, Wide Cablevision, Inc. wishes
to expand their coverage to include areas listed in Exhibit
"A" dated .July.10, 1979 and attached to this amendment,
and they have.'secured the approval of the Whatcom County
Engineer's Department for this extension; and,
WHEREAS, in the Franchise dated December 22, 1967, language
redured by Section 9.30 of the Home Rule Charter for Wha.tcom
County did not exist;
NOW, THEREFORE, BE IT ORDAINED that a Franchise dated Dec-
ember 22.,,"1967 entitled ".In the Matter of a Franchise to Install,
Operate and Maintain Audio- VisuFll,Cable Distribution Lines
along Certain. Roads: in "Whatcom:'..Cou' ty, Washington" is hereby
amended to include tlie': following two items:
SECTION 1: This''franchise;is subject to the. power of eminent
domain and the.righi,:of ahe. Council or the people .acting for them-
selves through' -.the ,nit'?�ati.ve`' or` xeferencium to repeal, amend, or
modify the franchise in the;..interest of the public:.
SECTION 2: The .fr4n,chise:'Af Nation Wide Cablevision, Inc.

shall include the locations listed 'in Exhibit "A" dated July
1979, a copy of 'which is attached., h.eretd. and As incorporated
by this reference as th'digh fullys'et out.

OF WHATCOM COUNTY, WASHINGTON
P E R M I T
NATION WIDE CABLEVISION. INC.
having applied for this permit and representing to the Council that they
intend immediately to construct Cable TV lines for service of customers
along the roads hereinafter named, and the Council being well and fully
advised in the premises.
IT IS NOW ORDERED that there is hereby granted unto
_ NATION WIDE CABLEVISION, INC. , its successors and assigns, a permit to
construct, maintain and operate cable television audio - visual lines
along, under and across the following described roads in Whatcom County,
Washington, outside of any incorporated city or town, to -wit:
ROADS AS LISTED ON THE ATTACHED EXHIBIT. "A1° DATED JULY 10, 1979
IT IS FURTHER ORDERED that prior to the time of any actual construction,
NATION WIDE CABLEVISION, INC._ shall obtain written approval from the
Whatcom County Engineer of the location of any installations hereunder.

Final payment shall not be made to any contractor constructing said lines
until written approval has been received from the Whatcom County Engineer.
THE ROADS ABOVE DESCRIBED SHALL LATER BE INCLUDED IN A FRANCHISE to said
NATION WIDE CABLEVISION, INC. under the same terms and conditions as
Franchises heretofore granted to the NATION WIDE CABLEVISION, INC.
by Whatcom County Council,
In the determination of the rights of the parties hereto, each shall be
bound to all of the terms and conditions as contained in the ptandard form of
Franchises heretofore granter to NATION WIDE CABLEVISION, INC.
