AN ORDINANCE ESTABLISHING A PROCEDURE TO
CLOSE OR RESTRICT USE OF WHATCOM COUNTY
PUBLIC ROADS WHENEVER ANY SUCH PUBLIC ROAD
BY REASON OF CLIMATIC CONDITIONS WILL BE
SERIOUSLY DAMAGED UNLESS THE OPERATION OF
VEHICLES THEREON BE PROHIBITED OR RESTRICTF�.
WHEREAS, the public roads in Whatcom County are subject to severe
damage when vehicles are driven on them during certain. weather conditions and

it would be in the best interest of the residents to protect the public roads;
and
WHEREAS, closing or restricting the use of the public roads of
Whatcom County during certain weather conditions woul.d reduce severe damage
to them;
NOW, THEREFORE, BE IT ORDAINED THAT:
(1) In accordance with the provisions of R.C.W. 46.44.080, whenever
due to emergency conditions the use of a county road by all 'vehicles or by
vehicles whose gross tire loads exceed those described in either schedule con-
tained in subsection (2) of this section, will damage the highway or will be
dangerous to traffic using the 'highway, the Public Works, Director, or the
County Engineer, shall close such road temporarily to.all vehicles or to a
designated class of vehicles, �s the case may be, by posting notices at each
end of the closed portion of road or roads.
[Mien imposing load .restrictions pursuant to this section, the Public
Works Director, or the County Engineer, shall. specify and display by posted
signs whichever of the following schedules of emergency load restrictions is

necessary to protect the road from damage in accordance with the conditions
i
then existing.

(1) No allowance will be made for any s�cond'rea'r axle that is
suspended from the frame of a, vehicle independent �f the (regular driving axle,

commonly . known as a "rigid trail axle." Allowance will: be made for single
tires only, on the front axl of !any truck.
2 The load distribution on an one axle of an vehicle shall be

such that it will not load the tires on said axle -fin excess of the prescribed
load set forth in this section; provided, that a truck, truck :tractor, pas-;
senger bus or school bus hav"ng',conventional 10;.Op,x 20.tires or 11 -22.5 tires,
or larger, may carry a maximum load of 10,000 lbs. on the front axle overlagy
county road placed under Emergency Load Restrictions.
(3) This rule shall not supersede or modify any rule in force
establishing load li.mitationJ on county road bridges.
Ordinance - 2.

1 (4) The Director of Public or the C;()T.int`: Pn95.. ee-
2 the authority to implement this ordinance by publishing and posting notice
3 in accordance with R.C.W. 47.48.020; provided, however, that in rase of emergenc
4 the County Executive, the Director of Public Works, or the County Engineer may,
e
5 witnout publication or delay, close county roads temporarily to all vehicles
6 or designated class of vehicles or place other conditionslor restrictions by
I
7 posting notice of same at each end of the closed portion of rbad or roads.

8 Such restrictions shall be effective immediately upon posting.
9 (5) The Director of'Public Works, or the CountylEngineer, pursuant
10 to R.C.W. 46.44.080, may issue special permits in writing authorizing the
s
11 operation of school buses, emergency vehicles and motor trucks transporting
12 perishable commodities or commodities necessary for the health and welfare of
13 local residents under specified weight and speed restrictions as may be neces-
14 sary to protect any county road from undue damage.
15 (6) Violations and Penalties. When any county road..or portion
16 thereof shall have been closed, as provided by this ordinance, any person,
17 firm or corporation disregarding'. ^such closing and using such county roads or
18 portions thereof with..any vehicle or any class of vehicles, as the case may
19 be, to which said county road or portion thereof is closed or restricted or
20 conditions placed thereupon by any notice or emergency notice, shall be
21 guilty of a misdemeanor and,shall, in, addition to any penalties for violation
22 of the provisions of this ordinance, be liable in any civil action instituted,
23 in the name of Whatcom County for any damages caused to county road or roads
24 or portions thereof, as the',ca'se may be, as a result of disregarding such
25 closing and using such county road or roads or portions thereof with any

26 vehicle or any class of vehicle or violation of conditions or restrictions to

27 which the road or roads or portions thereof is closed. In addition .thereto,
28 any person, firm or coraorat ion in violati.cn £s£ t iordinance or , ortJ ono
29 thereof shall be deemed guilty of a misdemeanor and each day during which
i
30 such violation is continued or committed shall constitute'a separate offense
31 and'upon conviction thereof shall be 'punished by a fine of not more than
32
$500.00 or by imprisonment in the county jail for a pariod not. exceeding 90
