ORDINANCE NO. 80 -6
AN ORDINANCE AMENDING WHATCOM COUNTY ORDIN-
ANCE NO., 79 -72, ADOPTED DECEMBER 6, 1979,
CONCERNING A FRANCHISE AGREEMENT BETWEEN
WHATCOM COUNTY AND PUGET SOUND POWER AND LIGHT
COMPANY, A WASHINGTON CORPORATION.
WHEREAS, Home Rule Charter 9.30 states that all
franchises granted by Whatcom County shall contain a reservation
of the power of eminent domain and the right of the Council or
the people acting for themselves through the initiative or ref-
erendum to repeal, amend or modify the franchise in the interest
of the public,
The County Council Does Ordain:
Ordinance No. 79 -72, An Ordinance Granting a Twenty -
Five Year Water and Wastewater Franchise on Certain County Roads
To Puget Sound Power and Light Company, a Washington Corporation
is hereby amended to include paragraph XXIII which states as
follows:
XXIII
This franchise shall be subject to the power of eminent
domain and the right of the Council or the people acting for
themselves through the initiative or referendum to repeal, amend
or modify the franchise in the interest 'of the public.
