NOW, THEREFORE, BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL that a new chapter is hereby added to Title 9 of the Whatc County Code, to be designated as Chapter 9.40, and which shall pro- vide as follows: CHAPTER 9.40 Disorderly House 9.40.010 Keeping of a Disorderly House Prohibited. It shall be unlawful.for any person who owns, leases, operates or is otherwise in control of any premises to wilfully make or continue, or cause to be made or continued, any loud or unusual noise which disturbs the peace or quiet of any neighborh or which causes discomfort or annoyance to any reasonable person of normal sensitiveness residing in the area. 9.40.020 Standards. The standards which shall be considered in determining whether a violation of the premises of this section exists shall include, but not be limited to, any one or'more of the following: The volume of noise; The intensity of the noise; Whether the nature of the noise is usual or unusual; Whether the origin of a noise is natural or unnatural; The proximity of the noise to residential sleeping facilities; 1 The density of the inhabitation of the area within which the noise emanates; 2 The time of the day or night the noise occurs; 3 The duration of the noise; Whether the noise is recurrent, intermittent, 4 or constant. 5 9.40.030 Penalty. 6 A violation of any provision of this chapter shall 7 constitute a misdemeanor. 8 PASSED this 5th day of August 1982. 9 10 11 12 13 ATTEST: 14 Y `� 15 C --or o --t lie Zo un 16 PP, OVED AS TO FORM: 17 18 BRUCE L.
