AN ORDINANCE EXTENDING THE EXISTING INTERIM ZONING ORDINANCE,
ADOPTED ON JULY 69 19729 TO JULY 159 1984.
Preamble: The Interim Zoning Ordinance for Whatcom County is to ex-
pire on July 15, 1982. The Whatcom County Planning Commission has not
yet devised a permanent Zoning Plan to present to the Whatcom County
Council. They are in good faith conducting studies toward that purpose.
It would be in the interest of public health, welfare and safety to extend,
as an emergency measure, the Interim Zoning Ordinance now in effect.
NOW, THEREFORE, BE IT ORDAINED:
SECTION 1: The duration of the Interim Zoning Ordinance adopted pursuant to
R.C.W. 36.70.790 on July 6, 1972 is extended to July 15, 1984. The Council finds that
an emergency exists which makes the extension necessary. The Council also finds that
the Whatcom County Planning Commission is in good faith conducting studies and
holding hearings for the purpose of formulating a permanent Zoning Plan.

PLANNING AGENCY REPORT
I. WHATCOM COUNTY PLANNING COMMISSION RESOLUTION
IN THE MATTER OF EXTENSION OF )
INTERIM ZONING ORDINANCE UNTIL ) FINDINGS, RECOMMENDATION
JULY 15, 1984 OR UNTIL FINAL ) AND MOTION
ZONING IS ADOPTED )
WHEREAS, the Interim Zoning Ordinance is due to expire on July 15, 1982; and
WHEREAS, a majority of the total Planning Commission members was in attendance
and favor extension of the Interim Zoning Ordinance.
NOW THEREFORE BE IT RESOLVED: THAT THE PLANNING COMMISSION ASSENTS
THE FOLLOWING FINDINGS AND REASONS FOR ACTION:
1. RCW 36.70.790 provides for adoption of temporary interim zoning map if the local plan-
ning agency is conducting studies and hearings for the purpose of enacting final land use
controls.
2. RCW 36.70.800 permits procedural actions without public hearing when, as in the in-
stant case, the action "does not impose, remove or modify any regulation theretofore
existing...."
3. The Whatcom County Planning Agency since 1972 has been conducting such studies
which have lead to the mapping of several precise zones in various areas of the County.
4. The adoption of an emergency measure such as interim zoning is necessary to protect
the public safety, health and general welfare while land use studies and plans are for-
mulated. Temporary land use control enable the local government to proceed carefully
in adopting "permanent" zoning without being forced to impose moratoriums stopping
all development.
5. Extension of the Interim Zoning Ordinance will preserve order, maintain the purposes of
the ordinance, and continue to further the objectives of the Comprehensive Plan Lentil
such time final zoning is adopted.
BE IT FURTHER RESOLVED:
1. The Planning Commission hereby recommends to the County Council that the Whatcom
County Interim Zoning Ordinance (Exhibit A) be extended for 24 months until July 15,
1984 or until final zoning is adopted.
2. The Chairman and Secretary of the Commission are hereby directed to place their sig-
natures on this document.

The Planning Department concurs with the Planning Commission's recommendation.
Further, the Planning Department suggests Council Action in the form of an ordinance
by July 15, 1982, the date of expiration of the current interim zoning ordinance.
