AN ORDINANCE ESTA..BLISHING P_ PROSECUTING ATTORNEY'S VICTIM /F?ITNESS FUND WHEREAS, the 1982 Washington Legislature has passed and the Governor has signed Second Substitute House Bill No. 828; and, WHEREAS, said'Bill contained an emergency clause and be- came effective on March 29, 1982; and, WHEREAS, said Bill provides that each Court of competent jurisdiction shall impose a penalty assessment upon each convicted person a sum of $50.Op for felony or gross misdemeanor convictions and $2,6.00 for misdemeanor convictions; WHEREAS, the Clerk of. the City Courts, District Courts and Superior Courts are directed by said Bill to monthly transmit said funds.to the County Treasurer; and, D;HEREAS, said.Bill provides that upon approval of the De- 20 partment of Labor and Industries of a program for victims and wit - 21 nesses of crimes to be administered by the Prosecuting Attorney, 22 20% of said penalty apsessments shall be provided to the Prosecuting 23 Attorney to be used e4clusively for comprehensive programs to en- 24 courage and facilitate testimony by the victims of, and witnesses 25 to crimes; and, 26 27 WHEREAS, the Department of Labor and Industries has been dvised that the Prosecuting Attorney intends to create such a pro - 28 - ram and seek approval, thereof; and has agreed that funds collected 29 may be retained pending such approval; and, 30 WHEREAS, said Bill requires that 20% of said penalty assess - 31 ent funds shall supplement and shall not supplant existing local 32 funds; INANCE - 1. 1 2 3 4 5 6 7i 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 NOW, THEREFORE, BE IT ORDAINED that the County Treasurer is hereby directed to establish the Whatcom County Prosecuting Attornek's Victim /Witness Fund to be used exclusively for the administration of a Victim /Witness Program by the Whatcom County Prosecuting Attorney and that said funds shall supplement and shall not suppl any existing funds for the Prosecuting Attorney; IT IS FURTHER ORDAINED that the Prosecuting Attorney shall submit an appropriate budget for said funds and,that the expendi- ture of said fund shall be subject to the adoption of said budget and approval of the plan by the Department of Labor and Industries, APPROVED thisl7th day of June , 1982.
