The Fire Marshal shall be appointed in accordance with the provisions of the Whatcom County Home Rule Charter and applicable personneX ordinances.and shall serve as the administrator of all County Fire Prevention and Investigation programs and activities. 2.04.020 Responsibilities The Fire Marshal shall have such powers as are conferred by State Law and, in addition, the following responsibilities in the unincorporated areas of Whatcom County and in such other areas as may be agreed upon through contractual arrangements with other. governmental entities. ORDINANCE - 1 1 A. To establish, with the approval of the Director of Public 2 Works, procedures for the issuance of permits, notifications of 3 closures or other legal actions, appeal of citations, approval of 4 detection and suppression systems, and enforcement of the Uniform 5 Fire Code, and to coordinate such activities with other building 6 code enforcement .functions of the County; 7 B. To disseminate within the County information concerning 8 the causes, prevention, and reduction of damage from fire and 9 explosion, and to assist and cooperate with appropriate officials 10 and agencies including, but not limited to, the following: State 11 Fire Marshal; County Fire Protection Districts; Police Authorities; 12 other Federal, State, or local agencies and private insurance 13 companies in the matter of fire investigation. 14 C. To notify the Chief of any Fire Department or District 15 affected, by telephone or mail within 72 hours, of all inspection 16 reports or other matters of record that may affect said Fire 17 Department or District. In the absence of more definite instruc- i8 tions, such communication shall be directed to the Fire Chief of i9 the affected Department or District. 20 D. To keep on file in his office all reports of fires and 21 explosions made to him pursuant to this Ordinance. E. 'To submit by the Thirty -first day of January an annual 23 report to the Director of Public'Works who shall, in turn, submit 24 copies of the report to the Whatcom County Executive, Whatcom 25 County Council, and one copy each to each Fire.District and any 26 other entity contracting for Fire Marshal services.. The report 27 shall contain a statement of the Fire Marshal's official acts 28 pursuant to.this Ordinance. 29 F. For'the purpose of coordinating the enforcement of the 30 Uniform Fire Code and other related codes, and for the purpose 31 of checking commercial and industrial plans and plats, the Fire 32 Marshal shall also be designated as the Chief Public Service ORDINANCE - 2 P 1 Inspector for the Bureau of Building and Codes Administration. 2 G. All investigations of the cause, origin and extent of 3 loss caused by fire and explosions shall be coordinated with the 4 Prosecuting Attorney's Office and,the County Sheriff's Department. 5 The Fire Marshal shall establish with these agencies procedures 6 for the reporting of fires and explosions. 7 2.04.030 Distribution of Ordinance 8 Copies of this ordinance shall be filed with the Department 9 of Public Works, Bureau of Building and Codes Administration, 10 County Auditor, State Examiner, Fire Chief's Association, all 11 Whatcom County Fire Districts and municipal fire departments, 12 State Insurance Commissioner, and such other agencies or other 13 individuals including, but not limited to, unions, contractors' 14 associations and insurance committees as deemed appropriate by 15 the Director of the Department of Public Works.. 16 2.04.040 Repealer 17 All County Ordinances and Resolutions, or parts of Ordinances 18 or Resolutions, inconsistent herewith are hereby repealed. 19 PASSED this lst day of April , 1982. 20 WHATCOM.
